How is the application for the certification of customs declaration regulated in Vietnam?
Pursuant to Clause 1, Article 1 of Circular 22/2019/TT-BTC stipulates the following application documents:
- Dossier of registration for the first time to issue a Customs Declaration Certificate, the contestant submits one (01) set of documents, including:
+ Registration form according to Form No. 01 issued together with this Circular;
+ College diploma or higher in economics, law and technology; 01 certified copy or 01 copy and present the original for comparison;
+ Two (02) 3x4cm color photos taken within 06 (six) months from the time of submission of the application with full name and year of birth on the back of the photo (01 photo pasted on the contest registration form, 01 photo pasted into the Certificate when issued).
+ A written record of learning results in case the diploma does not show that the major meets the conditions for exemption from the exam as prescribed in section a.1 point a and section b.1 point b, Clause 7 of this Article: 01 certified copy or 01 copy and present the original for comparison;
+ Written confirmation of the university or college in which the applicant works before retiring as a lecturer in case the test taker is subject to exemption as prescribed in section a.2 point a and section b.2 point b, Clause 7 of this Article: 01 original copy
- Application for re-examination of unsatisfactory subjects, the test taker submits one (01) set of documents, including:
+ Registration form according to Form No. 01 issued together with this Circular;
+ Two (02) 3x4cm color photos taken within 06 (six) months from the time of submission of the application with full name and year of birth on the back of the photo to be affixed to the exam registration form and certificate when issued.

Regulations on employees acting as customs clearance agents in Vietnam?
Pursuant to Article 20 of the 2014 Customs Law of Vietnam, it provides as follows:
- Conditions for customs clearance agents:
+ Having a business registration certificate or a certificate of enterprise registration with lines of goods forwarding services or customs clearance agents;
+ There are agents doing customs clearance;
+ Having information technology infrastructure that meets the conditions for e-customs declaration and other conditions as prescribed.
- Customs clearance agents who are Vietnamese citizens fully meet the following conditions:
+ Have a college degree in economics, law, and technology or higher;
+ Have a certificate of customs declaration;
+ Be issued a customs clearance agent identification number by the customs authority.
- The General Director of the General Department of Customs shall decide on the recognition, suspension and termination of customs clearance agents; issuance of certificates of customs declaration; issue and revoke the customs clearance agent identification number.
- Customs clearance agents and customs clearance agents shall exercise the rights and perform the obligations of customs declarants specified in Article 18 of this Law.
Thus, in order to take the exam for a customs declaration certificate, candidates must have a college degree in economics, law, and technology or higher and prepare complete documents as required in Clause 1 Article 1 of Circular 22/2019/TT-BTC.
How is the issuance of a customs declaration certificate regulated in Vietnam?
Pursuant to Article 4 of Circular 12/2015/TT-BTC (amended by Clause 2 Article 1 of Circular 22/2019/TT-BTC) stipulating as follows
- In case of being granted a customs declaration certificate:
+ Persons who have 03 subjects that meet the requirements specified at Points a and c, Clause 9, Article 3 of this Circular shall be granted a certificate of customs declaration.
+ Customs civil servants holding the rank of customs inspectors with 09 (nine) years of continuous work or main inspectors or senior inspectors after transferring, retiring or resigning (excluding cases of disciplinary dismissal) are granted customs declaration certificates within 03 years from the date of the decision to transfer, retirement or resignation.
- Issuance of customs declaration certificates:
+ For the cases specified at Point a, Clause 1 of this Article: Within 30 days from the date of notification of exam results on the Portal of the General Department of Customs, the General Director of the General Department of Customs shall issue a Certificate of customs declaration according to Form No. 03 issued together with this Circular.
+ For the cases specified at Point b, Clause 1 of this Article:
++ Within 03 years from the date of retirement or resignation or transfer of work, individuals wishing to issue customs declaration certificates shall submit an application form according to Form No. 11 issued together with this Circular to the General Department of Customs and enclose 01 3x4cm color photo taken within 06 (six) months from the time of submission of the dossier. full name, date of birth on the back of the photo.
++ Within 05 working days from the date of receipt of the written request, the General Department of Customs shall check the information on the records of officers kept at the General Department of Customs, compare them with the conditions specified at Point b, Clause 1 of this Article and the cases specified in Clause 2, Article 8 of this Circular to consider the issuance of certificates of maritime declaration. according to Form No. 03 issued together with this Circular or with a written response and clearly stating the reasons for the ineligibility case.
+ Customs declaration certificate is used to issue customs clearance agent identification number as prescribed in this Circular.
- The certificate of customs declaration will be sent to the person issued at the address registered on the exam form (for the case mentioned at Point a, Clause 1 of this Article) or on the written request (for the case mentioned at Point b, Clause 1 of this Article). In case of receiving directly at the place of issuance of the customs declaration certificate, present the identity card and sign it.
