Copyright registration declaration form according to the latest Vietnam regulations?

What is the order of issuance of copyright certificates in Vietnam?
Pursuant to subsection 1, Section A1, Chapter I, Part II, standardized administrative procedures within the scope of management functions of the Ministry of Culture, Sports and Tourism issued together with Decision 3684/QD-BVHTTDL in 2022, guide the implementation of steps in the order of issuance of copyright registration certificates as follows:
- Authors and copyright owners may directly or authorize other organizations and individuals to submit 01 copyright registration dossier at the head office of the Copyright Office or the Representative of the Copyright Office of the Copyright Office in Ho Chi Minh City, Representative of the Copyright Registration Office, related rights of the Copyright Office in Da Nang city.
- Within fifteen working days from the date of receipt of a valid application, the Copyright Office issues a Certificate of Copyright Registration. In case of refusal to issue a Certificate of Copyright Registration, written notice must be given to the applicant.
As for how to do it, entities can send it directly or by mail to:
- Copyright Office,
- Representative of the Copyright Registration Office, related rights of the Copyright Office in Ho Chi Minh City,
- Representative of the Copyright Registration Office, related rights of the Copyright Office in Da Nang city.
- Or apply online at the Public Service Portal of the Ministry of Culture, Sports and Tourism.
What does the composition of the copyright application include in Vietnam?
Pursuant to Subsection 1, Section A1, Chapter I, Part II, standardized administrative procedures within the scope of management functions of the Ministry of Culture, Sports and Tourism issued together with Decision 3684/QD-BVHTTDL in 2022 stipulating the composition of copyright registration dossiers include:
- Copyright registration declaration.
The declaration must be made in Vietnamese and signed by the author, copyright owner or authorized person submitting the application and full information about the applicant, author, copyright owner; summary of the content of the work; the name of the author, the work used as a derivative work if the work registered as a derivative work; time, place and form of publication; guarantee of responsibility for the information stated in the application;
- Two copies of copyrighted works;
- Power of attorney, if the applicant is an authorized person;
- Documents proving the right to apply, if the applicant enjoys that right of another person due to inheritance, transfer or inheritance;
- Written consent of co-authors, if the work is co-authored;43
- Written consent of the co-owners, if the copyright is jointly owned.
The above documents must be made in Vietnamese; in case it is made in a foreign language, it must be translated into Vietnamese.
- Number of applications: 01 set.
How much does it cost to issue a Copyright Certificate in Vietnam?
Pursuant to subsection 1 Section A1 Chapter I Part II Standardized administrative procedures within the scope of management functions of the Ministry of Culture, Sports and Tourism issued together with Decision 3684/QD-BVHTTDL in 2022
Then the fee for issuing a Copyright Certificate is:
- License fee: 100,000 VND/Certificate for various types of works:
+ Literary, scientific, textbook, textbook and other works expressed in written or other character form (collectively referred to as the type of written work);
+ Lectures, speeches and other speeches;
+ Journalistic works;
+ Musical works;
+ Photographic works.
- Copyright certificate fee: 300,000 VND/certificate for various types of works:
+ Architectural works;
+ Graphics, diagrams, maps, drawings related to topography, scientific works.
- License fee: 400,000 VND/Certificate for all types of works:
+ Shaping works;
+ Applied fine art works.
- Copyright certificate issuance fee: 500,000 VND/certificate for various types of works:
+ Cinematographic works;
+ Theatrical works are shaped on tapes and discs.
- License fee for computer programs, data collection or programs running on computers: 600,000 VND/Certificate.
Decision 3684/QD-BVHTTDL in 2022 will take effect from 01/01/2023.
