Vietnam: Can Kinh people living in ethnic minorities and mountainous areas to work abroad be supported expenses by the state?

I am a Kinh living in an ethnic minority area in a remote and disadvantaged area in Cao Bang province. Because I want to improve my life, I plan to work in China or Taiwan. However, my economy is quite tight while expenses for working abroad is very expensive. During the deadlock, the Commune Committee said the state will support expenses for working abroad. I hope to be informed about this issue!

On March 4, 2022, the Ministry of Finance issued Circular 15/2022/TT-BTC (effective from May 1, 2022). Accordingly, employees support in ethnic minority and mountainous areas who work abroad under contracts is mentioned with many support expenses to encourage economic development and improving living standards, the detailed content of Article 25 of Circular 15/2022/TT-BTC is as follows:

Content and support level for employees working abroad under labor contracts in Vietnam

For employees who are ethnic minorities, employees who are Kinh people in poor households living in ethnic minorities and mountainous areas

- Conduct vocational training, vocational skills retraining: According to actual costs; the maximum of level specified in Decision 46/2015/QD-TTg;

- Support for foreign language training: Maximum 4,000,000 VND/person/course;

- Support for meals and living expenses during the training period: 50,000 VND/person/day;

- Support for accommodation during the training period: 400,000 VND/person/month;

- Support for personal belongings (uniform clothes, blankets, mosquito nets, shoes...): 600,000 VND/person;

- Support for travel allowance (01 trip and return) for employees from the place of permanent residence registration to the training location: 200,000 VND/person/course for employees residing far from the training site create 15 km or more; the level of 300,000 VND/person/course for employees residing in areas with extremely difficult socio-economic conditions from 10 km or more from the training site;

- Expenses for carrying out procedures for employees working abroad:

+ Charges for issuing passports, travel permits and exit permits: the expenditures shall comply with the provisions of Circular 25/2021/TT-BTC dated April 7, 2021 of the Ministry of Finance, stipulating the collection rates and regimes. collect, pay, manage and use fees and charges in the field of exit, entry, transit, and residence in Vietnam;

+ Charges for providing criminal records: Fees for subjects who are not exempted from the fee shall comply with the provisions of Circular 244/2016/TT-BTC dated November 11, 2016 of the Ministry of Finance regulating the collection rates and regimes. collection, payment, management and use of fees for providing judicial record information;

+ Charges for Visa according to current regulations of the receiving country;

+ Charges for health examination are based on the price of medical examination and treatment services of medical examination and treatment establishments, the maximum support level is 750,000 VND/person.

Note: Kinh employees from near-poor households living in ethnic minority and mountainous areas are supported expenses for vocational training and vocational skills supplement according to actual costs with the maximum of level specified in Decision 46/2015/QD-TTg; support for foreign language training at actual costs, up to 70% and support for other costs according to the support level for ethnic minorities, Kinh employees belonging to poor households specified at point a of this clause.

Thus, if you are a Kinh person belonging to a poor household living in ethnic minority and mountainous areas and want to work abroad, you will be supported with the amounts mentioned above.

Support methods for employees working abroad under labor contracts in Vietnam

Support for training, supplementing vocational skills and foreign languages of employees who are supported through bidding, ordering, and assigning tasks with V and vocational training institutions, ​​or enterprises, non-business organization sending employees to work abroad.

In case the service provider is ineligible or cannot be selected, or the employee has completed the course previously, direct support will be provided to the employee when they are eligible to leave the country to work abroad based on actual invoices and documents.

Paying expenses to support employees working abroad under labor contracts in Vietnam

- For the case of bidding, ordering or assigning training tasks: paying expenses shall comply with the provisions of Article 24 of Decree 32/2019/ND-CP;

- For employees who have completed the course and are waiting for exiting.

The Department of Labor, War Invalids and Social Affairs provides support to subjects on the basis of invoices or receipts for payment for training, vocational skills improvement, foreign language, medical examination, passport, visa, criminal record and related documents proving that the employees are eligible for support .

Circular 15/2022/TT-BTC on the management and use of non-business funds for implementing the national target program for socio-economic development in ethnic minority and mountainous areas for the period 2021- 2030, phase I: from 2021 to 2025 issued by the Minister of Finance will officially take effect from May 1, 2022.
