What are the current regulations on transferring schools for students in Vietnam?
Pursuant to point g, Clause 3, Article 5 of Circular 10/2016/TT-BGDDT stipulating the transfer of schools for students:
“Article 5. Student’s rights
1. Gain admission to academic majors or professions that they have applied for if they satisfy all placement requirements set out by the Ministry of Education and Training and higher education establishments.
2. Get respect and equal treatment; receive all necessary personal information about their learning and training process as regulated by higher education establishments; have access to student education and training rules, and the State policies and regulations regarding students.
3. Obtain favorable conditions for their learning, scientific research and training, including:
a) Have access to libraries, necessary equipment and utilities for their learning, scientific research, cultural, artistic, sports and physical activities;
b) Participate in scientific researches, student competitions, student’s major Olympiad competitions, scientific and technological creativity contests;
c) Receive healthcare services prescribed by the State regulations in force;
d) Have opportunities to apply to study abroad and participate in international exchange programs; apply for transfer to a higher level of education as prescribed by regulations in force;
e) Have opportunities to be accepted into the Vietnam Communist Party, Ho Chi Minh Communist Youth Union and Vietnam National Union of Students; participate in student’s self-established organizations and social work activities inside and outside of higher education establishments as regulated by law; participate in cultural, artistic and sports activities which are worthwhile and match training objectives of higher education establishments;
f) Have access to social work services available at higher education establishment (including career orientation, employment counseling, physical and mental health counseling, underprivileged student support services, etc.)
g) Be entitled to temporary absence, intermission, low- or fast-progress study programs, dual degree programs or movement or transfer to other higher education establishments as permitted under training regulations of the Ministry of Education and Training; be entitled to summer vacation, lunar new year holidays and public holidays prescribed by law.”
Thus, according to the above regulations, students are allowed to transfer schools if they meet the provisions of the training regulations of the Ministry of Education and Training of Vietnam as above.

According to the application form mentioned above, the writing of the application form is prepared as follows:

What are the conditions for students to change majors, change places of study, change training institutions or change forms of study in Vietnam?
Pursuant to Article 16 of Circular 08/2021/TT-BGDDT stipulating the change of majors, change of study place, change of training institution, and change of study form for students as follows:
“Article 16. Transfer to another academic discipline, campus, training institution or mode of study
1. Conditions for transfer to another training program or academic discipline, transfer to another branch campus or transfer from a branch campus to the main campus:
a) The student is not a first-year student or final-year student, is not considered for forced leave from school and has not exceeded the permitted study time limit mentioned in Clause 5 Article 2 of this Regulation;
b) The student is eligible to enroll in the target training program or academic discipline or main campus (or branch campus) in the same cohort;
c) The training institution and main campus (or branch campus) meet quality assurance conditions and are capable of providing the training program or academic discipline as per existing regulations of the Ministry of Education and Training;
d) The transfer is approved by heads of academics units in charge of the training program or academic discipline, heads of campuses (current campus and target campus) and principal of the training institution.
2. Conditions for transfer to another training institution:
a) The student is not a first-year student or final-year student, is not considered for forced leave from school and has not exceeded the permitted study time limit mentioned in Clause 5 Article 2 of this Regulation;
b) The student is eligible to enroll in a training program or academic discipline of the target institution in the same cohort;
c) The target institution meets quality assurance conditions and is capable of providing the training program or academic discipline as per existing regulations of the Ministry of Education and Training;
d) The transfer is approved by the principals of the current training institution and target training institution.
3. Students may transfer from full-time study to part-time or remote study provided by their training institutions if they have not exceeded the permitted study time limit for the target mode of study according to regulations.
4. Training institution regulations shall provide for competence, conditions and procedures for transfer to another training program, academic discipline, campus, training institution or mode of study; and recognition of study results or transfer of accumulated credits for students making these transfers.”
Thus, the transfer of majors, places of study, transfer of training institutions, and change of study forms for students are regulated as above.
