What Does Staff Work Include?

Based on Clause 1, Article 2 of Regulation 114-QD/TW of 2023, the definition of Power in staff work is as follows:

Power in staff work is the authority of organizations and individuals in areas related to staff work, including: Recruitment, evaluation, obtaining votes of confidence, planning, training, fostering, selection, arrangement, assignment, appointment, reappointment, nomination, re-nomination, designation, transfer, rotation, secondment; promotion, demotion, stripping of military ranks; dismissal from positions, cessation of duties as a member of the National Assembly, People's Council; temporary suspension, suspension of positions, resignation, dismissal, removal from office; commendation, discipline; inspection, supervision, handling complaints and denunciations; implementing policies towards staff and internal political protection.

The areas in staff work are defined as follows:

- Recruitment, evaluation, obtaining votes of confidence, planning, training, fostering, selection, arrangement, assignment, appointment, reappointment, nomination, re-nomination, designation, transfer, rotation, secondment;

- Promotion, demotion, stripping of military ranks;

- Dismissal from positions, cessation of duties as a member of the National Assembly, People's Council;

- Temporary suspension, suspension of positions, resignation, dismissal, removal from office;

- Commendation, discipline;

- Inspection, supervision, handling complaints, denunciations;

- Implementing policies towards staff and internal political protection.

How are corrupt acts in staff work handled? What are the responsibilities for anti-corruption?

How Are Corrupt Acts in Staff Work Handled?

Based on the provisions of Article 14 of Regulation 114-QD/TW of 2023 as follows:

Handling Corruption and Negative Acts in Staff Work

1. Officials, party members, officials and public employees violating these Regulations will be considered and dealt with by the competent authorities. At the same time, the competent authorities will consider and apply the following handling measures:

a) If reprimanded, the person will be considered for planning after a minimum period of 12 months from the date the reprimand decision takes effect. They shall not be assigned to advisory roles or tasks related to organization, personnel, inspection, and audit work.

b) If warned, the person will be considered for dismissal. After a minimum period of 30 months from the date the dismissal decision takes effect, they shall not be assigned to advisory roles or tasks related to organization, personnel, inspection, and audit work.

c) If demoted, the person will be considered for planning after a minimum period of 60 months from the date the demotion decision takes effect. They shall not be assigned to advisory roles or tasks related to organization, personnel, inspection, and audit work.

d) If expelled from the Communist Party, it is proposed to the competent authority to consider dismissal or termination of the labor contract.

2. For acts of corruption and negative behavior in staff work, if violations are concluded, the records will be transferred to the competent authorities for consideration and handling according to regulations.

Thus, the handling of corrupt acts in staff work is carried out according to the content mentioned above.

Officials, party members, officials, and public employees violating these Regulations will be considered and handled by the competent authorities as per regulations.

For acts of corruption and negative behavior in staff work, if violations are concluded, the records will be transferred to the competent authorities for consideration and handling according to regulations.

What Are the Responsibilities for Anti-Corruption in Staff Work?

Based on the provisions of Article 12 of Regulation 114-QD/TW of 2023 as follows:

Responsibilities for Anti-Corruption and Negative Acts in Staff Work

1. Organizations and individuals are strictly prohibited from engaging in the behaviors stipulated in Article 3, Article 4, Article 5; Party committees, Party organizations, collective leadership, and members, heads, advisory staff, and personnel must strictly comply with the regulations in Article 6, Article 7, Article 8, Article 9, Article 10, and Article 11 of these Regulations.

2. Party committees, Party organizations, collective leadership, and heads of local administrations, agencies, and units within their scope of duties and powers are responsible for:

a) Detecting and receiving information related to corrupt and negative behaviors in staff work and handling them within their authority or proposing to the competent authorities for handling.

b) Providing information and complying with the requirements of the competent organizations and agencies during the process of inspecting and handling corrupt and negative behaviors in staff work in their agencies and units.

c) Promptly protecting and rewarding individuals who detect, report, provide information, and correctly denounce corrupt and negative behaviors in staff work; at the same time, strictly dealing with those who make false accusations and affect the reputations of others.

3. The Vietnam Fatherland Front, political-social organizations, and elected bodies, through the performance of their functions and duties, if detecting corrupt and negative behaviors in staff work, shall propose to the competent organization and agency for inspection and handling, and supervise the implementation of the proposals according to regulations.

4. Officials, party members, members of the National Assembly, and members of the People’s Council have the responsibility to detect and listen to the opinions of the People to report, denounce, and provide information to the competent authorities about corrupt and negative behaviors in staff work.

Thus, according to the above regulations, in staff work, the responsibilities for anti-corruption and negative acts are specified as above.
