Is it necessary to publicize the revocation of beauty pageant titles on mass media in Vietnam?

Pursuant to the provisions of Article 18 of Decree No. 144/2020/ND-CP stipulating as follows:

Revocation of titles and awards, cancellation of results of competitions and celebrations involving performance arts, beauty contests, model contests
1. Competent authorities specified under Clause 2 Article 17 of this Decree shall send request for revocation of titles and awards to organizers of competitions and celebrations in case:
a) Winners of titles and awards violate Article 3 of this Decree; or
b) Titles and awards granted at competitions and celebrations do not conform to schemes under application for written permission or announcement.
2. Organizers of competitions and celebrations shall revoke titles and awards at request of competent authorities, publicize revocation of titles and awards on mass media and be responsible for ensuring rights of relevant organizations and individuals as per the law.
3. In case of failure to revoke, competent authorities specified under Clause 2 Article 17 of this Decree shall decide to cancel results of competitions and celebrations after 5 working days from the date on which written request for revocation is issued and cancellation of results of competitions and celebrations is uploaded on website of competent authorities.

According to the above regulations, organizers of competitions and celebrations shall revoke titles at request of competent authorities, and publicize revocation of titles on mass media.

At the same time, they must be responsible for assuring rights of relevant organizations and individuals as per the law.

Referring to Article 3 of Decree No. 144/2020/ND-CP stipulating as follows:

Prohibited acts in performance arts
1. Scheming against the Government of Socialist Republic of Vietnam.
2. Distorting history, independence, sovereignty and territorial integrity of the Socialist Republic of Vietnam; infringing national security; denying revolution achievement; offending leaders, national heroes and historical figures; damaging national integrity; offending religions and beliefs; discriminating; violating legal rights and benefits of organizations and individuals.
3. Inciting violence, spreading wars of aggression, inciting conflict between ethnic groups and nationals of other countries, impacting diplomatic relationship.
4. Employing outfits, languages, sound, visual, movements, media or methods which go against tradition or affect moral, health and psychology of the general public negatively.

Thus, beauty pageant winner will have her title revoked when violating one of the following two cases:

- Winners of titles and awards violate the following prohibited acts:

+ Scheming against the Government of Socialist Republic of Vietnam.

+ Distorting history, independence, sovereignty and territorial integrity of the Socialist Republic of Vietnam;

+ Infringing national security;

+ Denying revolution achievement;

+ Offending leaders, national heroes and historical figures; damaging national integrity;

+ Offending religions and beliefs; discriminating; violating legal rights and benefits of organizations and individuals.

+ Inciting violence, spreading wars of aggression, inciting conflict between ethnic groups and nationals of other countries, impacting diplomatic relationship.

+ Employing outfits, languages, sound, visual, movements, media or methods which go against tradition or affect moral, health and psychology of the general public negatively.

- Titles and awards granted at competitions and celebrations do not conform to schemes under application for written permission or announcement.

What are administrative penalties for failing to publicly announce the revocation of titles on the mass media in Vietnam?

Pursuant to the provisions of Clause 3, Article 11 of Decree No. 38/2021/ND-CP as follows:

Violation against regulations on performing arts, performing arts contests, festivals
3. Imposing the fine ranging from VND 15,000,000 to VND 20,000,000 for one of the following violations:
a) Failing to revoke titles, prizes of performing arts contests and festivals when such revocation is required by a written request of the competent state authority;
b) Failing to publicly announce the revocation of titles, prizes of performing arts contests and festivals through mass media;
c) Using titles, awards of performing arts contests or festivals after they are revoked or decisions to cancel the results of performing arts contests or festivals are issued.

Thus, the act of failing to publicly announce the revocation of titles on the mass media may be subject to an administrative fine of between VND 15,000,000 and VND 20,000,000.

Note: The above fines for administrative violations are imposed on individuals; the fines incurred by an organization are twice as much as that incurred by an individual for the same administrative violation (pursuant to the provisions of Article 5 of Decree No. 38/2021/ND-CP as amended by Clause 2, Article 1 of Decree No. 128/2022/ND-CP).
