1. Principles for determining job positions
a) Follow the provisions of Article 3 of Decree No. 106/2020/ND-CP dated September 10, 2020 of the Government on job positions and number of people working in public service units (hereinafter abbreviated is Decree No. 106/2020/ND-CP).
b) Each job position must have a specific name and be associated with the position, leadership, management title or employee professional title class.
2. The basis for determining job positions is as prescribed in Clause 1, Article 4 of Decree No. 106/2020/ND-CP.
Thus, based on the above regulations, job positions in public scientific and technological organizations are determined based on the following principles and bases:

+ Ensure a reasonable structure, in which the number of people working at job positions with specialized professional titles and shared professional titles accounts for at least 65% of the total number of people working in the unit. public career.
- Job positions in public scientific and technological organizations are made based on the following bases:
+ Functions, tasks, powers, organizational structure of public service units;
+ Complexity, nature, characteristics, and scale of operations; scope and objects of service; Professional and professional management processes according to specialized laws.

Pursuant to the provisions of Article 4 of Decree 08/2014/ND-CP, scientific and technological organizations need to meet the following conditions to be established:

- Human resources for science and technology
- Technical facilities
- For public scientific and technological organizations, they must be consistent with the network of scientific and technological organization approved by the Prime Minister.
- For public scientific and technological organizations with foreign capital, they must meet the requirement specified as follows:
+ Purposes, contents and areas of operation should accord with laws, requirements for scientific and technological development and socio-economic development in Vietnam;
+ The establishment should be approved by the Minister of Science and Technology;
+ Be headquartered in localities under permission of People’s Committees of central-affiliated cities and provinces (hereinafter referred to as ‘People’s committees of provinces’);
- The Ministry of Science and Technology shall make specific guidance on Clauses 1, 2 and 3 of Article 4 of Decree 08/2014/ND-CP.
