Pursuant to Article 4 of Circular 18/2016/TT-BTC of Vietnam (amended by Clause 1, Article 1 of Circular 02/2023/TT-BTC of Vietnam) stipulating as follows:

Use funding support
The People's Committees of all levels shall use the funds paid by agencies, organizations, households and individuals that are allocated or leased land by the State for non-agricultural purposes from the land dedicated to growing wet rice and other sources of support funding as prescribed in Clause 2, Article 7 of Decree No. 35/2015/ND-CP dated April 13, 2015 of the Government on management and use of rice land to protect and develop cultivated land paddy. Depending on specific conditions, the locality will decide to do the following:
1. Support for ricegrowers:
Use not less than 50% of the funds used to support ricegrowers to apply new varieties, technical advances and new technologies in rice production; support linkage in production and consumption of products.
2. The remaining funds will be used for the following activities:
a) Analyze the chemical and physical quality of the areas specializing in wet rice cultivation with high yield and quality every 10 years for effective use and appropriate improvement measures: Based on economic norms technical, Units make cost estimates and submit them to competent authorities for decision;
b) Renovating and improving the quality of the land for specialized wet rice cultivation or the remaining land for wet rice cultivation: Based on the master plan and plan on land use for rice cultivation in each period approved by the local competent authority, the quality the amount of land specialized in wet rice cultivation in the area and the actual conditions of the locality, the People's Committee of the province shall direct the People's Committee of the district to make a plan to improve the quality of land specialized in wet rice cultivation or remaining paddy land for the whole period and each year, send it to the Department of Agriculture and Rural Development for summarizing and reporting to the Provincial People's Committee for approval. Based on the approved plan to improve the quality of rice land and economic and technical norms, the units shall make estimates of expenditures for improving the quality of rice land (increasing the thickness of the cultivable layer; exalting low-lying rice fields; increasing the flatness of the field; pickling, salt washing for soil contaminated with alum, saline and other soil improvement measures) submit to competent authorities for decision as a basis for implementation;
c) Investing in the construction, maintenance and repair of agricultural and rural infrastructure works in the commune, in which priority is given to investment in traffic and irrigation systems on rice-growing land;
d) Reclamation and restoration of unused land into specialized wet-rice land or remaining wet-rice land: The expenditure level is as prescribed in Clause 4, Article 7 of Decree No. 35/2015/ND-CP dated April 13, 2015 of the Government on the management and use of land for rice cultivation.

Accordingly, funds to support the protection and development of rice land are allocated and used as follows:

- Support for ricegrowers: Use not less than 50% of the funds used to support ricegrowers to apply new varieties, technical advances and new technologies in rice production; support linkage in production and consumption of products.

The remaining funds will be used to do the following:

+ Analyze the chemical and physical quality of the areas specializing in wet rice cultivation with high yield and quality every 10 years for effective use and appropriate improvement measures: Based on technical economic norms techniques, the units make cost estimates and submit them to competent authorities for decision;

+ To improve and improve the quality of the remaining land for wet rice cultivation or the remaining land for wet rice cultivation:

Based on the master plan and plan on land use for rice cultivation in each period approved by the competent authority of the locality, the quality of land specialized in wet rice cultivation in the locality and the actual conditions of the locality, the People's Committee of Provincial-level people direct the district-level People's Committees to draw up plans to improve the quality of the remaining wet rice-growing land or remaining wet-rice land for the whole period and each year, and send it to the Department of Agriculture and Rural Development for synthesizing and reporting to the People's Committee of the province for approval.

Based on the approved plan to improve and improve the quality of rice land and economic and technical norms, the units shall make estimates of expenditures on improving the quality of rice land (increasing the thickness of the cultivation layer;

What are the bases for making cost estimates for the protection and development of rice land?

Pursuant to Clause 1, Article 5 of Circular 18/2016/TT-BTC of Vietnam (amended by Clause 2, Article 1 of Circular 02/2023/TT-BTC of Vietnam) stipulating as follows:

Estimating, executing and finalizing budgets
1. About estimating
Annually, based on the plan on converting wet rice-growing land to use for non-agricultural purposes in the locality to determine the payable funding sources of agencies, organizations, households and individuals that are entitled to receive payment from the Government. The country allocates or leases land for non-agricultural purposes from the land specialized in wet rice cultivation and the state budget funds to support rice production in the local budget balance estimates, the Department of Finance shall Maintain and coordinate with the Department of Agriculture and Rural Development, the Department of Natural Resources and Environment and relevant agencies in formulating estimates of development investment and recurrent expenditures for submission to competent authorities for decision in accordance with regulations of the Law on State Budget, Law on Public Investment and relevant legal documents to protect and develop rice land according to the expenditures in Clause 4, Article 1 of Decree No. 62/2019/ND-CP.

According to that, when estimating the budget for the protection and development of rice land, the competent entity shall base on the plan to change the land specialized in wet rice cultivation to use for non-agricultural purposes in the locality to determine the payable funding sources by agencies, organizations, households and individuals that are allocated or leased land by the State for non-agricultural purposes from the land specialized in wet rice cultivation and state budget funds to support rice production in the local budget balance estimates.
