Who is eligible for an ID card from July 1, 2024?

Pursuant to the provisions of Article 19 of the Law on Identification 2023, it is clearly stated as follows:

Persons eligible for an ID card

1. Persons eligible for an ID card are Vietnamese citizens.

2. Vietnamese citizens aged 14 years and above must complete procedures for obtaining an ID card.

3. Vietnamese citizens under the age of 14 may be issued an ID card upon request.

Pursuant to the provisions of clause 1 Article 23 of the Law on Identification 2023, the procedure for issuing an ID card to individuals aged 14 years and above from July 1, 2024, is clearly stated as follows:

Step 1: The recipient examines and verifies the information of the person requiring the ID card from the National Database on Population, national databases, and specialized databases to accurately identify the individual requiring the ID card.

In case the information of the individual requiring the ID card is not available in the National Database on Population, the procedures for updating and adjusting information into the National Database on Population must be performed according to the provisions of clauses 1, 2, and 3 of Article 10 of the Law on Identification 2023.

Step 2: The recipient collects identification information and biometric data including facial photos, fingerprints, and iris scans of the person requiring the ID card.

Step 3: The individual requiring the ID card reviews and signs the identification information collection form.

Step 4: The individual requiring the ID card reviews and signs the identification information collection form (duplicated step).

Step 5: The recipient issues an appointment slip for the ID card release.

Step 6: The ID card is delivered to the location stated in the appointment slip. If the individual requiring the ID card requests delivery to a different location, the identity management agency shall deliver the ID card to the requested location, and the individual must pay for the delivery service fee.

Note: In the case of an individual with a loss of civil capacity or difficulty in cognition and behavioral control, a legal representative is required to assist in the above procedures.

If the ID card issuance is denied, the identity management agency must provide a written response stating the reasons.

How is the procedure for issuing an ID card to individuals under 14 years old carried out?

Pursuant to the provisions of clause 2 Article 23 of the Law on Identification 2023, it is clearly stated as follows:

2. An individual under 14 years old or the legal representative of an individual under 14 years old may request the identity management agency to issue an ID card. The procedure for issuing an ID card to individuals under 14 years old is carried out as follows:

a) The legal representative shall perform the ID card issuance procedures for individuals under 06 years old through the online public service portal or national identification application. In case the individual under 06 years old has not yet registered for birth, the legal representative shall perform the ID card issuance procedures through interlinked procedures with birth registration on the online public service portal, national identification application, or directly at the identity management agency. The identity management agency shall not collect identification and biometric data for individuals under 06 years old;

b) Individuals aged 06 years to under 14 years shall accompany their legal representative to the identity management agency to collect identification and biometric data as stipulated in point b clause 1 of this Article.

The legal representative of individuals aged 06 years to under 14 years shall perform the ID card issuance procedures on their behalf.

Accordingly, the procedure for issuing an ID card to individuals under 14 years old is carried out as follows:

Individuals under 14 years old or their legal representative may request the identity management agency to issue an ID card.

For individuals under 06 years old

- The legal representative shall perform the ID card issuance procedures for individuals under 06 years old through the online public service portal or national identification application.

In case individuals under 06 years old have not yet registered for birth, the legal representative shall perform the ID card issuance procedures through interlinked procedures with birth registration on the online public service portal, national identification application, or directly at the identity management agency.

The identity management agency shall not collect identification and biometric data for individuals under 06 years old.

For individuals aged 06 years to under 14 years

- Individuals aged 06 years to under 14 years shall accompany their legal representative to the identity management agency to collect identification and biometric data.

- The recipient shall collect identification and biometric data including facial photos, fingerprints, and iris scans of the individual requiring the ID card.

- The legal representative of individuals aged 06 years to under 14 years shall perform the ID card issuance procedures on their behalf.

The Law on Identification 2023 will come into effect from July 1, 2024, except for clause 3 of Article 46 of the Law on Identification 2023.
