How to declare prices for management of domestic air transportation services in Vietnam and aviation according to current regulations?
According to the provisions of Article 8 Circular 36/2015/TT-BGTVT on management of prices for domestic air transportation services in Vietnam and prices of specialized aviation services issued by the Minister of Transport as amended by Clause 2, Article 1 Circular 07/2017/TT-BGTVT is as follows:
"Article 8. Method of price declaration
1. 05 working days before the declared price, the service-providing organization or individual makes 02 sets of dossiers. The price declaration form shall be sent to the Civil Aviation Authority of Vietnam in one of the following ways:
a) Directly;
b) Send by post;
c) Send by email with an electronic signature or a scanned copy of the Form signed and red stamped or sent via fax and telephone to notify, and at the same time send by official mail
2. A price declaration dossier includes:
a) A document of the organization or individual, including the time period. , the effect of the declared price and the attached documents;
b) The manifest of the specific price;
the price declaration dossier specified in Appendix 2 issued with this Circular.
3. In case of an increase. or discount within 5% of the declared price Immediately before that, the organization or individual providing the selected service shall send a notice of price according to Form No. 2 in the Appendix issued with this Circular or send a price declaration dossier to the Civil Aviation Authority of Vietnam.
4. In case the price is adjusted to increase or decrease by more than 5% compared to the previously declared price (including the case of accumulation of consecutive price increases and decreases in the form of sending price notices). ), organizations and individuals providing services must declare prices according to regulations."

According to Clause 2, Article 1 Circular 06/2022/TT-BGTVT amending Article 8 Circular 36/2015/TT-BGTVT on declaration of prices for price management of domestic air transportation services in Vietnam as follows:
“Article 8. Price declaration
1. Organizations and individuals providing services on the list specified in Article 7 of this Circular shall have to declare prices.
2. The Civil Aviation Administration of Vietnam is responsible for receiving the service price declaration documents from the service-providing organizations and individuals specified in Clause 1 of this Article.
3. Methods of making and receiving price declarations comply with the provisions of Circular No. 56/2014/TT-BTC dated April 28, 2014 of the Minister of Finance guiding the implementation of Decree No. 177/2013. /ND-CP dated November 14, 2013 of the Government detailing and guiding the implementation of a number of articles of the Law on Prices; Circular No. 233/2016/TT-BTC dated November 11, 2016 of the Minister of Finance amending and supplementing a number of articles of the Minister's Circular No. 56/2014/TT-BTC dated April 28, 2014 The Ministry of Finance guides the implementation of Decree No. 177/2013/ND-CP dated November 14, 2013 of the Government detailing and guiding the implementation of a number of articles of the Law on Prices.”.
Thus, from July 15, 2022, regulations on organizations and individuals shall be added to be responsible for declaring prices for management of domestic and specialized aviation services.
Who are the organizations and individuals responsible for declaring prices and managing prices of domestic and specialized aviation services?
According to Article 7 Circular 36/2015/TT-BGTVT on the list of services for making declaration of prices for price management of domestic and specialized aviation services as follows:
"Article 7. List of declaration services Pricing
1. Services specified in Clauses 2 and 3, Article 5 of this Circular
2. Aviation services falling under the pricing competence of service-providing organizations and individuals, including:
a) Services transporting goods and postal items inland;
b) Technical services for ground trade (except for services provided under bilateral or multilateral cooperation contracts);
c) Cargo handling services at ports. aviation;
d) Equipment use services in the terminal;
dd) Other services at the airport."
Thus, according to the provisions of Circular 06/2022/TT-BGTVT amending Circular 36/2015/TT-BGTVT stipulating that organizations and individuals providing services on the list of regulations listed above are responsible for implementing Executing the declaration of prices for management of domestic air transportation services in Vietnam and specialized in aviation.
Circular 06/2022/TT-BGTVT takes effect from July 15, 2022.
