On July 5, 2024, the Minister of Home Affairs of Vietnam issued Circular 8/2024/TT-BNV providing guidance on adjusting the monthly allowance for commune-level officers who are old and retired.

Below is the content regulating the calculation of allowances from July 1, 2024, for commune-level officers in Vietnam who are old and retired:

Article 2 of Circular 8/2024/TT-BNV stipulates the adjustment of the monthly allowance as follows:

Adjustment of the monthly allowance

From July 1, 2024, adjust the monthly allowance for old and retired commune-level officers as prescribed in Article 2 of Decree No. 75/2024/ND-CP dated June 30, 2024, of the Government of Vietnam, which adjusts pensions, social insurance benefits, and monthly allowances as follows:

1. Increase the monthly allowance by 15% of the allowance enjoyed as of June 2024 for the subjects specified in Article 1 of this Circular.

The monthly allowance from July 1, 2024, is calculated using the following formula:

Where: The allowance as of June 2024 is the allowance stipulated in Clause 3, Article 2 of Circular No. 11/2023/TT-BNV dated August 1, 2023, of the Minister of Home Affairs guiding the adjustment of the monthly allowance for old and retired commune-level officers.

2. From July 1, 2024, after adjusting the monthly allowance for old and retired commune-level officers as prescribed in Clause 1 of this Article, if the allowance is less than 3,500,000 VND/month, it is to be further adjusted as follows:

Article 1 of Circular 8/2024/TT-BNV provides regulations on the subjects as follows:

Applicable Subjects

Commune-level officers who are old and retired and are currently receiving a monthly allowance according to Decision No. 130-CP dated June 20, 1975, of the Council of the Government of Vietnam, supplementing policies for commune-level officers and Decision No. 111-HDBT dated October 13, 1981, of the Council of Ministers on amending and supplementing some policies for commune-level officers (hereinafter referred to as old and retired commune-level officers).

The subjects eligible for increased monthly allowance from July 1, 2024, according to Circular 8/2024/TT-BNV are:

Commune-level officers who are old and retired and are currently receiving a monthly allowance according to Decision 130-CP 1975 dated June 20, 1975, of the Council of the Government of Vietnam, supplementing policies for commune-level officers and Decision 111-HDBT 1991 dated October 13, 1981, of the Council of Ministers on amending and supplementing some policies for commune-level officers (hereinafter referred to as old and retired commune-level officers).

How many health insurance cards are issued to old and retired commune-level officers receiving a monthly allowance from the state budget of Vietnam?

Old and retired commune-level officers receiving a monthly allowance from the state budget are issued how many health insurance cards, according to the provisions in Clause 2, Article 16 of the Law on Health Insurance 2008, amended by Clause 10, Article 1 of the Amended Law on Health Insurance 2014, as follows:

Health Insurance Card

1. A health insurance card is issued to participants of health insurance as the basis for enjoying health insurance benefits under this Law.

2. Each person is issued only one health insurance card.

3. The validity of the health insurance card is regulated as follows:

a) The subjects specified in Clauses 1, 2, and 3 of Article 12 of this Law, joining health insurance for the first time, will have their health insurance card valid from the date of health insurance payment;

b) For individuals continuously participating in health insurance from the second time onwards, the health insurance card is valid uninterrupted from the expiry date of the previous card;

c) For the subjects specified in Clauses 4 and 5 of Article 12 of this Law, participating in health insurance from the date this Law takes effect or not continuously for 3 months or more within a financial year, the health insurance card will be valid after 30 days from the date of health insurance payment;

d) For children under 6 years old, the health insurance card is valid until the child turns 72 months old. If the child reaches 72 months without entering school, the health insurance card remains valid until September 30 of that year.

4. The health insurance card is invalid in the following cases:

a) The card has expired;

b) The card is modified, erased;

c) The named cardholder no longer participates in health insurance.

Hence, according to the above provisions, old and retired commune-level officers receiving a monthly allowance from the state budget are issued one health insurance card.
