According to Clauses 1 and 2, Article 11 of Decree 61/2024/ND-CP, the organization of ministerial and provincial councils in Vietnam is as follows:

(1) The ministerial-level council at the Ministry of Culture, Sports, and Tourism, the Ministry of Defense, the Ministry of Public Security is established by the Minister; at Vietnam Television, the Voice of Vietnam is established by the General Director.

- Number of Council members: From 9 to 11 members.

- Council Composition:

Chairperson: Representative of the leadership of the Ministry of Culture, Sports, and Tourism, Ministry of Public Security, Ministry of Defense, the Voice of Vietnam, or Vietnam Television;

Vice-Chairpersons: The head of the department for emulation and commendation of the Ministry of Culture, Sports, and Tourism, or a representative of the leadership of the department for emulation and commendation of the Ministry of Public Security, Ministry of Defense, the Voice of Vietnam, Vietnam Television; the head of the department for cultural and artistic activities of the Ministry of Culture, Sports, and Tourism, Ministry of Public Security, Ministry of Defense, the Voice of Vietnam, Vietnam Television;

Council Members: Experts in the field of culture, arts; People's Artists, Artist of Merits.

- The Council uses the seal of the ministries and central authorities where the ministerial council is established.

- The department for emulation and commendation of the Ministry of Culture, Sports, and Tourism, or the department for emulation and commendation of the Ministry of Public Security, Ministry of Defense, the Voice of Vietnam, Vietnam Television is the standing agency of the Council.

- The Council has a Secretariat established by the Chairperson of the Council.

(2) The provincial-level council is established by the Chairperson of the Provincial People's Committee.

- Number of Council members: From 9 to 11 members.

- Council Composition:

Chairperson: Vice Chairperson of the Provincial People's Committee;

Vice-Chairpersons: Representative of the leadership of the Propaganda Department; Director or Deputy Director in charge of culture and arts of the Department of Culture, Sports, and Tourism or the Department of Culture and Sports;

Council Members: Representative of the leadership of the Department of Home Affairs; representative of the leadership of the Union of Literary and Art Associations or the local Literary and Art Association; experts in the fields of culture and arts; People's Artists; Artist of Merits in the field of local culture and arts.

- The Council uses the seal of the Provincial People's Committee.

- The Department of Culture, Sports, and Tourism or the Department of Culture and Sports is the standing agency of the Council. The standing agency of the Council is allowed to use the seal of the unit in performing some of the activities of the Council as authorized by the Chairperson of the Council;

- The Council has a Secretariat established by the Chairperson of the Council.

What Are the Principles for Awarding the People's Artist title and Artist of Merit title?

According to Article 4 of Decree 61/2024/ND-CP, the principles for awarding the People's Artist title and Artist of Merit title in Vietnam are as follows:

- Implement according to points a, b, and c, Clause 2, Article 5 of the Law on Emulation and Commendation 2022. To be specific:

2. Commendation is carried out according to the following principles:

a) Accurate, public, transparent, fair, promptly;

b) Ensure consistency between the form, the object of commendation, and the services, achievements;

c) A form of commendation may be awarded multiple times to the same object; not commend multiple times, multiple forms for the same achievement; award commendation according to the level of achievement;

- The councils at all levels may only present cases that meet the conditions, standards, procedures, and files as prescribed in Decree 61/2024/ND-CP to the competent authorities for consideration.

- The titles of "People's Artist" and "Artist of Merit" are not awarded to co-authors of musical and photographic works.

What Are the Working Principles of the Ministerial and Provincial Councils in Vietnam?

According to Clause 3, Article 11 of Decree 61/2024/ND-CP, the working principles of the ministerial and provincial councils are as follows:

- Individuals with applications requesting the award of the title "People's Artist" or "Artist of Merit" do not participate in the Council;

- The Council works on the principles of democracy, publicity, and secret ballot;

- The Council organizes a meeting when at least 90% of the Council members are present, including the Chairperson or the Vice-Chairperson authorized by the Chairperson;

- The Council reviews the dossiers, procedures, and processes of the grassroots council; assesses the reputation, professionalism, and impact of each individual whose dossier proposes the award of the title "People's Artist" or "Artist of Merit" according to the standards stipulated in Article 7 or Article 8 of Decree 61/2024/ND-CP;

- The ministerial or provincial council only reviews dossiers submitted by the grassroots council according to the procedures and files stipulated in Articles 13 and 14 of Decree 61/2024/ND-CP.
