From August 1, 2024, what are regulations on eligibility for renting official housing in Vietnam? What are the regulations on land for official housing construction in Vietnam?
Pursuant to Article 30 of Decree 95/2024/ND-CP on eligibility for renting official housing in Vietnam:
(1) For individuals specified in point a of clause 1, Article 45 of Housing Law 2023, they must be currently holding the position.
(2) For individuals specified in point b of clause 1, Article 45 of Housing Law 2023, they must meet the following conditions:
- Have an official decision of transfer, rotation, or secondment for work and documents proving they are eligible to rent official housing;- Do not own a house and have not rented, leased-to-buy, or bought social housing at the place of the new job, or have owned a house at the new job location but with an average living area per household member of less than 20 square meters.
(3) For individuals specified in point d of clause 1, Article 45 of Housing Law 2023, they must meet the following conditions:
- Have an official decision of transfer, rotation, or secondment for work and documents proving the individual is an officer, professional soldier, non-commissioned officer, laborer in the police or defense forces; cipher worker and other personnel in cipher organizations paid from the state budget and belonging to the people’s armed forces;- Meet housing conditions according to point b of clause 2, Article 30 of Decree 95/2024/ND-CP;- Do not fall under the category that must reside in the people's armed forces barracks as stipulated by the Ministry of Defense and the Ministry of Public Security.
(4) For individuals specified in points c and dd of clause 1, Article 45 of Housing Law 2023, they must meet the following conditions:
- Have an official decision of transfer, rotation, or secondment to work in areas specified in points c or dd of clause 1, Article 45 of Housing Law 2023;- Meet the difficult housing conditions according to point b of clause 2, Article 30 of Decree 95/2024/ND-CP; if being dispatched to work in rural areas in the lowland or midland regions, it must be outside the district and at least 30 kilometers from their residence to the new workplace.
In cases of working in rural areas in remote or economically disadvantaged regions, border areas, or islands, the Provincial People's Committee will stipulate an appropriate distance based on the actual situation of each area. However, this distance must be at least 10 kilometers from their residence to the new workplace.
(5) For individuals specified in point e of clause 1, Article 45 of Housing Law 2023, they must comply with the following conditions:
- Have an official decision to take charge of a particularly important national science and technology task as prescribed by science and technology law;- Have an official decision recognizing them as a talent with significant contributions to the nation as prescribed by law;- Meet the difficult housing conditions according to point b of clause 2, Article 30 of Decree 95/2024/ND-CP.

What are the regulations on land for official housing construction in Vietnam?
Pursuant to Article 40 of Housing Law 2023, the regulations on land for official housing construction in Vietnam are as follows:
(1) The land area for the construction of official housing is specifically determined in the approved construction plan.
(2) For official housing of central agencies, the Ministry of Construction will lead and cooperate with the Provincial People's Committee to determine the land area for the construction of official housing in the locality, except in cases specified in (3). The Provincial People's Committee is responsible for allocating land for official housing construction as required by the Ministry of Construction.
(3) For official housing for individuals belonging to the people's armed forces as stipulated in this Law, the Ministry of Defense and the Ministry of Public Security will lead and cooperate with the Ministry of Construction and the Provincial People's Committee to determine the land area for the construction of official housing for individuals belonging to the people's armed forces.
(4) For local official housing, the Provincial People's Committee is responsible for allocating land for official housing construction when planning and approving the plan as prescribed by law.
(5) The State does not collect land fees for the area used for the construction of official housing as stipulated in Article 40 of Housing Law 2023.
What is the principle for the operation management, operation, maintenance, leasing management during use of official housing in Vietnam?
Pursuant to clause 1, Article 3 of Decision 11/2024/QD-TTg, official housing must be built in sync with infrastructure works, ensuring criteria on construction density, land use coefficient, and other criteria in accordance with the construction plan, standards, and regulations, including:
- Villas with a maximum height of 4 floors and a construction land area from 300 m2 to 500 m2 (except as specified in clause 1, Article 4 of Decision 11/2024/QD-TTg), with garden spaces, fences, and separate entrances, ensuring security and protection systems as prescribed;
- Adjacent houses with a maximum height of 4 floors and a construction land area from 60 m2 to 250 m2, designed as garden houses or townhouses, built close together, sharing the same infrastructure system;
- Apartments ranging in usable area from 45 m2 to 160 m2, designed with self-contained living space, with one or more functional spaces such as a living room, bedrooms, dining room, kitchen, bathroom, and balcony or loggia;
- Grade IV adjacent houses with usable area from 24 m2 to 60 m2, built as one-floor houses with multiple adjacent units, each unit having self-contained ancillary works. The minimum usable area is 24 m2/unit.
