What contents of fixed passenger transport bus routes will be announced by the Department of Transport in Vietnam?

Based on Article 32 of Circular 12/2020/TT-BGTVT, the regulations are as follows:

“Article 32. Announcement of opening passenger transport routes by bus

1. The Department of Transport announces the opening of passenger transport routes by bus at the local level according to the route network list approved by the Provincial People's Committee. For bus routes passing through multiple provinces or cities, based on the approved route network list, the announcement of route opening is conducted by the Department of Transport where the bus route is headquartered, after receiving uniform written approval from the Department of Transport at the other end of the route and the Department of Transport that the route passes through. If the bus route has a starting or ending point within an airport area, the Provincial People's Committee must coordinate with the Ministry of Transport before announcing the opening of the route.

2. Contents of the bus route opening announcement

a) Enterprise, cooperative exploiting the route;

b) Route number or code; distance; itinerary (starting point, endpoint, stops);

c) Bus schedule, operating time of the route;

d) Brand, capacity, distinctive color of buses operating on the route;

đ) Ticket price.

3. The Department of Transport must announce the contents specified in clause 2 of this Article on its website no later than 15 days before implementing passenger transport activities on the bus route.”

The Department of Transport will announce the opening of fixed passenger transport bus routes at the local level based on the above-stated contents. The announcement on the Department's website is no later than 15 days before implementing fixed bus route passenger transport activities.

What are the regulations on management of passenger transport by bus in Vietnam?

Based on Article 33 of Circular 12/2020/TT-BGTVT, the regulations are as follows:

“Article 33. Management of passenger transport by bus

1. The Department of Transport organizes bidding or orders exploitations of passenger transport routes by bus according to the laws and regulations on the production and provision of public-utility products and services.

2. Enterprises and cooperatives with a business license for passenger transport by automobile in the form of buses can register to participate in bidding or be contracted to exploit passenger transport routes by bus.

3. The local Department of Transport signs route exploitation contracts with bidding winning enterprises and cooperatives or those contracted. The contract must clearly specify the route exploitation plan, including route name, route number, bus brand, bus capacity, ticket price, bus schedule on the route, and contract duration.

4. The Department of Transport decides to adjust part or all of the bus schedule and route itinerary of intra-provincial bus routes when there are changes in traffic organization leading to route itinerary changes, in cases of natural disasters, storms, floods, or other force majeure, or at the request of enterprises, cooperatives exploiting the route to meet actual demand and conditions at different times. Enterprises and cooperatives adjust route exploitation plans corresponding to the new bus schedule; the Department of Transport and enterprises, cooperatives sign and stamp confirmation of the new exploitation plan as part of the route exploitation contract.

5. For bus routes passing through multiple provinces or cities, the adjustment of the bus schedule, itinerary, suspension, or closure of the route is conducted by the Department of Transport where the bus route is headquartered, after receiving uniform written approval from the local Department of Transport at the other end of the route; notify the Departments of Transport with bus routes passing through before implementation.

6. Decisions on adjusting the bus schedule must be announced on public media no later than 10 days before implementation.”

The current management of passenger transport business activities by bus will be implemented according to the above-stated regulations.

Vietnam: Is it mandatory for transport business operating fixed-route bus services to use paper transport orders?

Based on clause 6 of Article 30 of Circular 12/2020/TT-BGTVT, the regulations are as follows:

“Article 30. Starting point, ending point, stops, and bus shelters, transport order

6. Transport order

a) Transport orders are printed by enterprises or cooperatives according to the prescribed sample in Appendix 6 issued with this Circular. Besides the mandatory contents stipulated in Appendix 6, enterprises or cooperatives may add other content to facilitate the unit’s management;

b) Enterprises or cooperatives are responsible for managing, issuing, and checking the use of the transport orders; storing completed transport orders for a minimum of 05 years.”

Thus, currently, the transport business operating fixed-route bus services will print the transport orders themselves. Therefore, currently, transport orders only exist in paper form.

In the future, changes will be made according to regulations in clause 5 of Article 1 of Circular 17/2022/TT-BGTVT as follows:

“Article 1. Amendments and supplements to several articles of Circular 12/2020/TT-BGTVT dated May 29, 2020, by the Minister of Transport, regulating the organization and management of transport activities by automobile and support services for road transport

...

5. Amend and supplement point a clause 6 of Article 30 as follows:

“a) Transport orders in paper or electronic form are issued by the enterprise or cooperative according to the prescribed sample in Appendix 6 issued with this Circular. Besides the mandatory contents stipulated in Appendix 6, enterprises or cooperatives may add other content to facilitate the unit’s management.

Drivers must carry the transport order in paper form or have a device that can access the content of the electronic transport order; present the paper or electronic transport order when requested by the authorities.

The provision of information on the transport order is implemented according to the regulations in clause 4 of Article 51 of this Circular.”

In the future, the transport business operating fixed-route bus services can issue transport orders in either electronic or paper form.

Circular 17/2022/TT-BGTVT will take effect from September 15, 2022.
