From August 15, 2022, individuals must pay fees when exploiting and using information systems on housing and real estate market?

I would like to ask the following question: In the near future, what forms of exploitation and use of database on housing and real estate market are there in Vietnam?

What forms of exploitation and use of housing and real estate market databases are there?

Pursuant to Clause 2 Article 24 of Decree 44/2022/ND-CP of Vietnam stipulating as follows:

“Article 24. Exploitation and use of information systems on housing and real estate market
2. Types of exploitation and use of database on housing and real estate market include:
a) Through the portal of the information system on housing and real estate market (http://www.batdongsan.xaydung.gov.vn); Portal of the Department of Construction;
b) Approval of the request form or written request;
c) By contract between the management agency of the housing and real estate market information system and the party exploiting and using data on housing and real estate market in accordance with the law.”

Thus, there are 03 forms of exploitation and use of database on housing and real estate market according to the above regulations.

What to do when registering and granting the right to exploit and use information and data on housing and real estate market?

Pursuant to Clause 3 Article 24 of Decree 44/2022/ND-CP of Vietnam stipulating as follows:

“Article 24. Exploitation and use of information systems on housing and real estate market
3. Registration and grant of the right to exploit and use information and data on housing and the real estate market are done as follows:
a) Organizations and individuals wishing to register for the grant of the right to exploit and use information and data on housing and the real estate market shall send a request form to the agency or unit assigned to manage and provide information and data on housing and real estate market. Information and data on housing and real estate market in the following forms: Submitted directly in writing to the Supplier; Send by official letter, fax, post office; Online registration on the Website of the Provider;
b) Within no more than 07 working days from the date of receipt of the request, the Supplier shall consider granting the right to access the right to exploit and use valid information and data on housing and the real estate market; In case of refusal to provide the right to exploit and use, the Supplier must reply clearly stating the reason.”

Are individuals required to pay fees when exploiting and using information systems on housing and real estate market?

Pursuant to Clause 4 Article 24 of Decree 44/2022/ND-CP of Vietnam stipulating as follows:

“Article 24. Exploitation and use of information systems on housing and real estate market
...
4. Objects, scope of exploitation and use
a) Agencies involved in building and maintaining databases on housing and real estate market may exploit data under their management. The exploitation of data on housing and real estate market outside the scope of management must be approved by the agency managing the housing and real estate market information system;
b) State management agencies are required to connect and share information on housing and relevant real estate market to serve state management, investigation, verification and handling of violations of the law;
c) Agencies, organizations and individuals other than those specified at Points a and b of this Clause are entitled to request sharing and provision of information on housing and real estate market in accordance with the law on access to information;
d) Agencies managing the housing and real estate market information system must not share or provide information affecting national security, business secrets of enterprises, information that is individuals, except for the case of serving investigation, verification and handling of law violations and serving the state management of competent agencies.”

The subjects specified at Point c Clause 4 of this Article, when wishing to use information, must pay fees for exploitation and use of information on housing and real estate market as prescribed.

Where is the information about housing and real estate market published?

Pursuant to Article 25 of Decree 44/2022/ND-CP of Vietnam stipulating as follows:

“Article 25. Disclosure of information on housing and real estate market
1. The Ministry of Construction periodically publishes basic information on housing and real estate market nationwide at the Portal of the information system on housing and real estate market (http:/ /www.batdongsan.xaydung.gov.vn) including:
a) Annually: before December 31 of the year of publication of the statistical data specified in Article 9 of this Decree;
b) Quarterly: the last day of the quarter to publish the statistics specified in Article 14 of this Decree.
2. Provincial-level People's Committees assign the Department of Construction to periodically publish basic information about local housing and real estate market on the portal managed by the unit, including:
a) Annually: before December 31 of the year of publication of the statistical data specified in Article 9 of this Decree;
b) Quarterly: the last day of the quarter to publish the statistics specified in Article 14 of this Decree.”

According to the above regulations, the disclosure of information on housing and the real estate market must comply with the above regulations.

Decree 44/2022/ND-CP of Vietnam will take effect from August 15, 2022.
