Shall a member of Communist Party of Vietnam be disciplined for being indifferent or insensitive to urgent issues that have been reflected affecting the lives of the people?

In what cases will a member of Communist Party of Vietnam be disciplined for failing to heed the people's feedback?

Pursuant to Clause 1, Article 14 of Regulation 69-QD/TW, 2022:

"Article 14. Violations in leadership, direction, and organization of receiving people's feedback, supervision, and social criticism of the Fatherland Front and socio-political organizations

1. Committing any of the following violations, causing minor consequences, will result in a reprimand:

a) Lack of responsibility in directing, inspecting, and supervising the reception of legitimate people's feedback, supervision, and social criticism of the Fatherland Front and socio-political organizations as prescribed.

b) Failing to handle or direct the handling of violations in receiving people's feedback, supervision, and social criticism of the Fatherland Front and socio-political organizations, harming the reputation of the party committee and party organization.

c) Exploiting the reception of feedback to distort the content of feedback from the Fatherland Front, socio-political organizations, and the people towards the party organization and state agencies.

d) Indifference and insensitivity, failing to report urgent and wrongful issues that have been reflected, significantly affecting the interests and lives of the people..."

From July 06, 2022, a Communist Party member who is indifferent or insensitive to urgent issues that have been reflected affecting the lives of the people will be disciplined?

When  will a member of Communist Party of Vietnam be disciplined with a warning for failing to heed the people's feedback?

Pursuant to Clause 2, Article 14 of Regulation 69-QD/TW, 2022:

"Article 14. Violations in leadership, direction, and organization of receiving people's feedback, supervision, and social criticism of the Fatherland Front and socio-political organizations

...

2. First-time violations as stipulated in Clause 1 of this Article causing serious consequences, repeated offenses, or one of the following cases will be disciplined with a warning:

a) Failing to lead, direct, urge, inspect, and supervise relevant authorities in addressing recommendations from the Fatherland Front and socio-political organizations as prescribed by the Communist Party and state law.

b) Failing to lead or direct state agencies, the Fatherland Front, and socio-political organizations in direct dialogue with citizens as prescribed, leading to political and social instability in agencies, units, or localities.

3. Disciplinary action in the form of dissolution will be applied in cases of having policies, actions against, or exploiting people's feedback, supervision, and criticism from the Fatherland Front and socio-political organizations to distort the policies, regulations of the Communist Party, and state law, causing particularly serious consequences."

What were the previous regulations on violations of democratic centralism?

Pursuant to Article 8 of Regulation 102-QD/TW, 2017:

"Article 8. Violations of democratic centralism

1- Members of Communist Party of Vietnam committing any of the following violations causing minor consequences will be disciplined with a reprimand:

a) Lacking responsibility in complying with resolutions, directives, decisions, regulations, rules, conclusions of the Communist Party, and state laws.

b) Being incited, instigated, bribed, enticed, or coerced into activities causing loss of democracy, internal solidarity.

c) Being instigated or enticed into actions against the principles of the Communist Party organization and operations; violating democratic rules, working regulations of the party committee, party organization, and agency or unit where they work.

d) Threatening or retaliating against those who question, comment, criticize, or accuse them in any form.

dd) Failing to comply with reporting policies, information policies, and responding to questions as prescribed by the Communist Party and state laws.

2- In cases where a member has been disciplined according to Clause 1 of this Article but repeats the offense, or commits an initial offense causing serious consequences, or commits one of the following cases, they will be disciplined with a warning or removal from office (if holding a position):

a) Exploiting positions and powers to veto the opinions of the majority when passing resolutions, directives, decisions, regulations, rules, and conclusions under the jurisdiction of the collective.

b) Participating in or inciting, coercing others into activities that cause internal division and disunity.

c) Deceiving superiors, reporting falsely, distorting the truth; concealing defects, violations of themselves, others, or the organization; creating false achievements; opportunism, scrambles for positions, authoritarianism.

d) Sectarianism, factionalism, authoritarianism in directing and managing leading to violations of democratic centralism.

dd) Issuing documents or taking actions contrary to resolutions, decisions, regulations, rules, and conclusions of the party committee or party organization.

e) Exploiting democratic centralism to lobby individuals, dominate the collective, making decisions based on subjective will for personal gain, family, factions or clans.

g) Exploiting positions and powers to oppress subordinates, retaliate against those with minority opinions or contrary opinions.

h) Disobeying leadership decisions, directives, resolutions, regulations, rules, and conclusions of the superior and their own party organizations.

i) Deliberately speaking and acting against resolutions, decisions, and conclusions that have been collectively agreed upon.

3- Violations stipulated in Clause 1 and Clause 2 of this Article causing very serious consequences or one of the following cases will be disciplined with expulsion:

a) Being unorganized, undisciplined, leaving their posts repeatedly without a justifiable reason; acting against the policies, resolutions, directives, decisions, regulations, rules of the Communist Party and policies, and laws of the state.

b) Exploiting democratic rights for factionalism, group interests, or local interests causing division in organizations, agencies, units where they are members.

c) Retaliating against those who comment, fight, criticize, or accuse, or those who provide information, documents, evidence related to violations of their agencies, units, organizations, or individuals."

Thus, from July 06, 2022, a member of Communist Party of Vietnam who is indifferent or insensitive to urgent issues that have been reflected affecting the lives of the people will be disciplined depending on the consequences caused.
