Procedures for Granting Law Practice Certificates to Those Who Pass the Law Practice Internship Results Examination

According to the provisions of Subsection 1, Part 2 of Administrative Procedures issued in conjunction with Decision 706/QD-BTP in 2023, the procedures for granting a Law Practice Certificate to those who pass the law practice internship results examination are as follows:

Step 1: The individual who meets the requirements of the law practice internship results examination shall submit an application for a Law Practice Certificate to the Executive Committee of the Bar Association.

Step 2: Within seven working days from the date of receipt of a valid application, the Executive Committee of the Bar Association shall forward the application to the Department of Justice along with a confirmation that the applicant meets the lawyer qualifications prescribed by the Law on Lawyers.

Within seven working days from the date of receipt of a valid application, the Department of Justice shall be responsible for examining the application. When necessary, the Department shall verify the legality of the application and send a request letter along with the application for a Law Practice Certificate to the Ministry of Justice.

Within twenty days from the date of receipt of a valid application, the Minister of Justice shall decide whether to issue the Law Practice Certificate.

In cases of refusal, written notice specifying the reasons must be provided to the applicant for the Law Practice Certificate and the Department of Justice that submitted the application.

Contents of the Application for a Law Practice Certificate for Those Who Pass the Law Practice Internship Results Examination

According to the provisions of Subsection 1, Part 2 of Administrative Procedures issued in conjunction with Decision 706/QD-BTP in 2023, the application for a Law Practice Certificate for those who pass the law practice internship results examination shall include:

- An application form for a Law Practice Certificate issued by the Ministry of Justice;- Criminal record certificate;- Health certificate;- Copies of the Bachelor of Laws or Master of Laws degree;- Copy of the certificate of law practice internship results;- An explanatory document and commitment about the process of complying with the Constitution and laws, with good moral character, confirmed by the agency or organization where the applicant worked last before applying for the Law Practice Certificate or by the local police at the commune, ward, commune-level town where the applicant resides (for cases as prescribed in Clause 2, Article 2a of Decree 137/2018/ND-CP).

Note:

In cases where information about the residence of the applicant for a Law Practice Certificate is needed, officials, public employees, and individuals responsible for receiving, processing administrative procedures, and providing public services shall retrieve citizen residence information from the National Database on Population using one of the methods as prescribed in Clause 2, Article 14 of Decree 104/2022/ND-CP.

If unable to retrieve citizen residence information by the methods mentioned in Clause 2, Article 14 of Decree 104/2022/ND-CP, the relevant authority, officials, public employees, and individuals responsible for receiving, processing administrative procedures, and providing public services may request the citizen to submit or present a copy of one of the documents proving residence information as prescribed in Clause 3, Article 14 of Decree 104/2022/ND-CP. The documents proving residence information as listed in Clause 4 of Article 14 include:

- Citizen identification card,- Identity card,- Certificate of residence information,- Personal identification number and citizen information notice in the National Database on Population.

Processing Time for Issuing a Law Practice Certificate for Those Who Pass the Law Practice Internship Results Examination

According to the provisions of Subsection 1, Part 2 of Administrative Procedures issued in conjunction with Decision 706/QD-BTP in 2023, the processing time for issuing a Law Practice Certificate to those who pass the law practice internship results examination is as follows:

- Within 7 working days from the date of receipt of a valid application, the Executive Committee of the Bar Association shall forward the application to the Department of Justice along with a confirmation that the applicant meets the lawyer qualifications prescribed by the Law on Lawyers.- Within seven working days from the date of receipt of a valid application, the Department of Justice shall be responsible for examining the application.
