Mandatory Termination of Postal Transaction Office Activities of Lien Viet Post Joint Stock Commercial Bank in Which Cases?

Based on Article 15 of Circular 43/2015/TT-NHNN (amended by Clause 7, Article 1 of Circular 11/2023/TT-NHNN), the regulations are as follows:

Mandatory Termination of Postal Transaction Office Activities

1. A postal transaction office is mandated to terminate activities when:

a) Activities are not in accordance with the provisions stipulated in Article 7 of this Circular;

b) All savings deposits have been paid out or have been taken over by Lien Viet Post Joint Stock Commercial Bank in case of failure to pay out all matured savings deposits as stipulated in Clause 4, Article 7 of this Circular.

2. Based on the provisions in Clause 1 of this Article, the State Bank branch at the location where the postal transaction office is headquartered shall issue a document requesting Lien Viet Post Joint Stock Commercial Bank to terminate the activities of the postal transaction office.

3. Within 45 (forty-five) days from the date the State Bank branch at the location where the postal transaction office is headquartered issues the document as stipulated in Clause 2 of this Article, Lien Viet Post Joint Stock Commercial Bank must complete the termination of the postal transaction office; a written report on the termination date must be submitted to the State Bank branch at the location where the postal transaction office is headquartered.

4. In case of a complaint against the request of the State Bank branch at the location where the postal transaction office is headquartered for mandatory termination of the postal transaction office activities, Lien Viet Post Joint Stock Commercial Bank shall proceed with the complaint procedures in accordance with the current legal regulations on complaints.

Accordingly, a postal transaction office is mandated to terminate activities when:

- Activities are not in accordance with the provisions stipulated in Article 7 of Circular 43/2015/TT-NHNN;

- All savings deposits have been paid out or have been taken over by Lien Viet Post Joint Stock Commercial Bank in case of failure to pay out all matured savings deposits as stipulated in Clause 4, Article 7 of Circular 43/2015/TT-NHNN.

The State Bank branch at the location where the postal transaction office is headquartered shall issue a document requesting Lien Viet Post Joint Stock Commercial Bank to terminate the activities of the postal transaction office.

Additionally, within 45 (forty-five) days from the date the State Bank branch at the location where the postal transaction office is headquartered issues the document, LPBank must complete the termination of the postal transaction office; a written report on the termination date must be submitted to the State Bank branch at the location where the postal transaction office is headquartered.
