Implementation of Biometric Authentication Application, Use of Population Data, Electronic Identification and Authentication in Air Travel Procedures
On December 29, 2023, the Minister of Transport issued Circular 42/2023/TTBGTVT, amending and supplementing certain articles of Circular 13/2019/TTBGTVT and Circular 41/2020/TT-BGTVT providing detailed regulations on the Aviation Security Program and Aviation Security Quality Control of Vietnam; which includes regulations on the implementation of biometric authentication for passengers during air travel procedures.
On December 13, 2023, the Civil Aviation Authority of Vietnam (CAAV) received report 5134/BC-TCTCHKVN-KTCNMT year 2023 from the Airports Corporation of Vietnam on the technical plan for the application of biometric authentication and the use of population data, electronic identification and authentication for passengers during air travel procedures.
On April 3, 2024, the Civil Aviation Authority of Vietnam received report 1253/BC-TCTCHKVN-KTCNMT year 2024 from the Airports Corporation of Vietnam on the full implementation of biometric authentication and the application of population data, electronic identification and authentication for passengers during air travel procedures.
Based on legal regulations, reports from the Airports Corporation of Vietnam, and directives from the Ministry of Transport in Document 6285/BGTVT-TTCNTT year 2024 on the implementation of biometric authentication application for passengers during air travel procedures; and comments from the Ministry of Public Security in Document 1853/BCA-C06 year 2024 regarding the plan for the application of biometric authentication for passengers during air travel procedures, in Official Dispatch 3076/CHK-ANHK year 2024, the CAAV requests the Airports Corporation of Vietnam:
(1) Organize the development of a detailed plan for the implementation of biometric authentication and the use of population data, electronic identification and authentication for passengers during air travel procedures, ensuring the following contents:
- Comply with regulations in Decree 13/2023/ND-CP of the Government of Vietnam on personal data protection;
- Coordinate with professional units under the Ministry of Public Security (C06, A08) in inspecting the security and information safety of equipment and information systems before officially putting them into operation; appraise and evaluate the cybersecurity and information security plan if any;
- Plan the authentication of data integrity and accuracy in the chip of the Citizen Identity Card according to the guidance of units under the Ministry of Public Security in Document 68/RAR-B1 year 2023 from the Research and Application Center for Population Data and Citizen Identity.
(2) Report the implementation progress to the CAAV every 6 months (by June 25 and December 25).

What are the obligations of passengers when flying?
The obligations of passengers when flying are specified in Article 148 of the Civil Aviation Law of Vietnam 2006 and include:
- Complying with aviation safety and security regulations.
- Following the carrier’s instructions during transportation.
- Compensating for damages caused by the passenger’s fault to the carrier or the aircraft operator.
What are the rights of passengers when flying?
Article 147 of the Civil Aviation Law of Vietnam 2006, as amended by Article 1, clause 39 of the Civil Aviation Law of Vietnam Amendment 2014, specifies the rights of passengers when flying as follows:
- Being informed in writing about the carrier’s liability limits for compensation in cases of passenger death, injury, baggage damage, loss, and delayed transportation.
- In case the passenger is not transported due to the carrier’s fault, the passenger has the right to request the carrier to arrange a suitable itinerary or refund the unused portion of the ticket.
- In the cases specified in Article 146 of the Civil Aviation Law of Vietnam 2006, passengers are entitled to a refund of the ticket price or the corresponding amount for the unused portion of the ticket, after deducting fees and penalties stated in the Carrier’s Conditions of Carriage.
- Declining the flight; if already in transit, passengers have the right to decline further travel at any airport, landing field, or compulsory landing place, and are entitled to a refund of the ticket or the corresponding amount for the unused portion of the ticket, after deducting fees and penalties stated in the Carrier’s Conditions of Carriage.
- Waiver of baggage service charges at the minimum level stated in the Carrier’s Conditions of Carriage.
- Children under twelve years of age traveling by air are eligible for waived or reduced service charges at the level specified in the Carrier’s Conditions of Carriage.
Children aged two to under twelve years are assigned separate seats; children under two years do not have separate seats and must be accompanied by an adult.
