Foreign workers must declare information by themselves according to Form No. 03, in case foreigners are unable to do so, the organization or enterprise employing foreign workers shall declare information.

How is the report on the use of foreign workers regulated?
According to Article 6 of Decree 152/2020/ND-CP stipulating reports on employment of foreign workers as follows:
"Article 6. Report on employment of foreign workers
1. Before July 5 and January 5 of the following year, the foreign employer shall report on the first 6 months of the year and annually on the situation of using foreign workers using Form No. 07/PLI Appendix Appendix I promulgate together with this Decree. How is the collection of information on foreign workers working in Vietnam regulated?
According to Article 13, Article 14 of Circular 01/2022/TT-BLDTBXH, stipulating the collection of information about foreigners as follows:
(1) Collected content
- First and last name; date of birth; sex; nationality; passport; work permit.
- Professional qualifications and training specialties.
- Job position; Job Title; working form; type of business, working organization; work experience; practicing certificate (if any).
- Location and working time.
- When there is a change or error in the process of collecting information about foreign workers working in Vietnam specified in Clause 1 of this Article, agencies, organizations and individuals are responsible for collecting information. update and edit.
(2) Implementation Procedure
- From the information system, the data approves the need to use foreign workers; foreign workers who are not subject to work permits; issue, re-issue, extend and revoke work permits in accordance with the law on foreign workers working in Vietnam, the Department of Labor, War Invalids and Social Affairs collects and updates information , data on the system to store and synthesize labor market information about foreign workers working in Vietnam according to Form No. 03 issued together with this Circular.
- In case foreign workers comply with the provisions of Point a, Clause 1, Article 30 of Decree 152/2020/ND-CP dated December 30, 2020 of the Government on regulations on foreign workers working in Vietnam. To recruit and manage Vietnamese employees working for foreign organizations and individuals in Vietnam, the Employment Department shall collect them according to Form No. 03 issued together with this Circular.
