Summary of National Centralized Drug Procurement Demand within the Time Limit according to Circular 07?
Pursuant to Clause 2, Article 22 of Circular 07/2024/TT-BYT, the time limit for summarizing national centralized procurement demand is as follows:
- The time limit for Departments of Health, medical facilities, and focal points to aggregate and send centralized procurement demand as specified by the national central procurement unit, but not exceeding 45 days;
- After a maximum period of 45 days from the date the national central procurement unit first issues a document about aggregating procurement demand, if the Departments of Health, medical facilities, and focal points do not send their procurement demand, they are considered as having no procurement demand;
- In cases where the Departments of Health, medical facilities, and focal points send their procurement demand but do not attach the documents according to the provisions of Article 24 of this Circular, the national central procurement unit shall issue a written request to supplement the dossier.
Within 5 working days from the date the national central procurement unit issues a written request to supplement the dossier, if the Departments of Health, medical facilities, and focal points do not send the documents or send incomplete documents as requested, the national central procurement unit shall determine and aggregate the procurement demand based on the quantity of drugs used and the proposal from the Departments of Health, medical facilities, and focal points but the quantity shall not increase more than 30% compared to the corresponding quantity used in the previous period or the previous 12 months as per the procurement demand summary announcement;
- If necessary, to promptly ensure drugs for the medical needs of public health facilities, the national central procurement unit can determine the procurement demand, including the optional additional purchase amount (if any), based on the actual usage quantity of the previous period or the previous 12 months up to the time the procurement demand is determined, but the quantity shall not increase more than 30% compared to the corresponding quantity used in the previous period or the previous 12 months up to the time the procurement demand is determined.
Based on this, the national central procurement unit shall send a document to public health facilities under the management of the Ministry of Health, departments, and the local central procurement unit to review and verify the procurement demand.
Within a maximum of 30 days from the date the national central procurement unit issues a document to review and verify the procurement demand, if the public health facilities under the management of the Ministry of Health, departments, or the local central procurement unit do not send a document to confirm the procurement demand, they are deemed as having no procurement demand;
- After summarizing the procurement demand of the Departments of Health, medical facilities, and focal points, the national central procurement unit shall seek written opinions from Vietnam Social Security regarding the procurement demand.
Within 10 days from the date the national central procurement unit issues a document seeking opinions, Vietnam Social Security must provide a specific written response regarding the procurement demand.
If the aforementioned time limit is exceeded and Vietnam Social Security does not provide a written response or provides a response after the time limit, it is considered that Vietnam Social Security agrees with the procurement demand aggregated and reviewed by the national central procurement unit.
If Vietnam Social Security disagrees with the procurement demand proposed by the national central procurement unit seeking opinions: the national central procurement unit shall consider and explain the opinions of Vietnam Social Security.
In cases where there are unresolved contentions with Vietnam Social Security's opinions, within 05 working days from the date of receiving the opinions of Vietnam Social Security, the national central procurement unit must organize a meeting with Vietnam Social Security to reach a consensus.
The opinion of the representative attending the meeting on behalf of Vietnam Social Security is the official opinion of Vietnam Social Security.
If there is no consensus at the meeting, the issue shall be reported to the Ministry of Health for consideration and decision.
If Vietnam Social Security does not send a representative to attend the meeting, it is considered that Vietnam Social Security agrees with the procurement demand completed by the national central procurement unit after considering and explaining Vietnam Social Security's opinions.

The Department of Preventive Medicine shall lead, cooperate with the Central Institute for Hygiene and Epidemiology, and the national central procurement unit to guide the determination and aggregation of procurement demand or based on the actual usage quantity of medical facilities, the supplier's supply capability from the previous procurement period, and the projected number of users to determine the procurement demand, with optional additional purchase quantities (if any).
The Department of Preventive Medicine is responsible for the procurement demand and shall send a written proposal to the national central procurement unit;

When medical facilities send proposals for centralized drug procurement demand, they must attach the following documents:
- A summarized report on the implementation of contractor selection results, the drug usage situation of the previous 12 months and the previous period up to the time of the procurement demand summary announcement, inventory quantities, and unimplemented quantities in the plan of the previous period at the time of procurement demand determination.
- A concise explanation of the proposed drug procurement demand. If the quantity increases by more than 30% compared to the quantity used in the previous period or the previous 12 months up to the time of procurement demand determination, it must be specifically explained and justified.
- Documents that serve as the basis for planning the contractor selection according to regulations.
- Meeting minutes reviewing and agreeing on the list and quantities of drug procurement demand from:
+ The Drug and Treatment Council regarding the list, quantities, and drug usage demand of medical facilities.
+ The Department of Health for drugs under the centralized procurement list of medical facilities under the management of the Department of Health, including private medical facilities and medical facilities under the management of departments and sectors located in the area (excluding medical facilities under the Ministry of Health).
For newly established medical facilities or those with a procurement demand for the first time, when sending the summarized procurement demand, they are not required to attach documents specified in Clause 1, Article 24 of Circular 07/2024/TT-BYT.
