What are public holidays in Vietnam in 2024?

(1) New Year Holiday 2024 (Point a Clause 1 Article 112 Labor Code 2019)

employees are entitled to a day off with full pay on New Year's Day (January 1).

(2) Lunar New Year Holiday 2024 (Point b Clause 1 Article 112 Labor Code 2019)

employees are entitled to five days off with full pay during the Lunar New Year.

On November 3, 2023, the Office of the Government of Vietnam issued Official Dispatch 8662/VPCP-KGVX in 2023 on Lunar New Year and National Day holidays in 2024.

The Lunar New Year holiday schedule for officials and public employees, employees is as follows:

- For officials and public employees: They will have time off from Thursday, February 8, 2024, to the end of Wednesday, February 14, 2024 (i.e., from December 29, Year of the Cat to the end of January 5, Year of the Dragon). During the Lunar New Year holiday in 2024, officials and public employees will have 7 days off (including 5 days off for the Lunar New Year and 2 compensatory days off as per Clause 3 Article 111 Labor Code 2019).

- For employees:

According to Official Dispatch 4594/LDTBXH-ATLD, based on actual conditions and the schedule for officials and public employees, employers are encouraged to arrange the Lunar New Year holiday for employees similar to the schedule for officials and public employees and announce the Lunar New Year holiday plan to employees at least 30 days in advance.

(3) Reunification Day and International Labor Day Holidays 2024 (Points c, d Clause 1 Article 112 Labor Code 2019)

employees are entitled to a day off with full pay on:

- Reunification Day: 1 day (April 30).

- International Labor Day: 1 day (May 1).

April 30, 2024, falls on a Tuesday, and May 1, 2024, falls on a Wednesday.

Hence, for the holidays of April 30 and May 1, 2024, employees will have 2 consecutive days off.

(4) National Day Holiday September 2, 2024 (Point đ Clause 1 Article 112 Labor Code 2019)

employees are entitled to two days off with full pay on National Day: September 2 and one adjacent day.

On November 3, 2023, the Office of the Government of Vietnam issued Official Dispatch 8662/VPCP-KGVX in 2023 on Lunar New Year and National Day holidays in 2024.

The Government of Vietnam agreed on the National Day holiday from August 31, 2024, to the end of September 3, 2024.

- For employees:

(5) Hung Kings' Festival Holiday 2024 (Point e Clause 1 Article 112 Labor Code 2019)

employees are entitled to a day off with full pay on the Hung Kings' Festival: 1 day (March 10 of the lunar calendar).

March 10 of the lunar calendar in 2024 falls on a Thursday.

Hence, for the Hung Kings' Festival holiday in 2024, officials and public employees, employees are entitled to 1 day off.

Public Holidays and Tet

1. employees are entitled to days off with full pay on the following public holidays:

a) New Year's Day: 1 day (January 1);

b) Lunar New Year: 5 days;

c) Reunification Day: 1 day (April 30);

d) International Labor Day: 1 day (May 1);

dd) National Day: 2 days (September 2 and 1 adjacent day);

e) Hung Kings' Festival: 1 day (March 10 of the lunar calendar).

The Prime Minister of the Government of Vietnam agreed with the proposal of the Ministry of Labor, Invalids and Social Affairs in Official Dispatch 4594/LDTBXH-ATLD in 2023 on the Lunar New Year holiday from February 8, 2024, to the end of February 14, 2024, and the National Day holiday from August 31, 2024, to the end of September 3, 2024.

For employees in enterprises, the Ministry of Labor, Invalids and Social Affairs stated that based on actual conditions and the schedule for officials and public employees, employers should arrange the Lunar New Year holiday for employees as follows (encouraging employers to apply the Lunar New Year holiday for employees as regulated for officials and public employees).

- Lunar New Year Holiday in 2024:

+ Choose 1 day before Tet and 4 days after Tet or 2 days before Tet and 3 days after Tet or 3 days before Tet and 2 days after Tet.

+ Notify the Lunar New Year holiday plan to employees at least 30 days in advance.

The Lunar New Year 2024 falls on Saturday and Sunday of the week, hence the number of Tet holidays in 2024 for employees will be as follows:

*For employees not required to work on Saturdays

- Companies choosing the plan of 1 day before Tet and 4 days after Tet:

employees will start the Lunar New Year holiday from Friday, February 9, 2024 (December 30, Year of the Cat) until the end of Thursday, February 15, 2024 (January 6).

- Companies choosing the plan of 2 days before Tet and 3 days after Tet:

employees will start the Lunar New Year holiday from Thursday, February 8, 2024 (December 28, lunar calendar) until the end of Wednesday, February 14, 2024 (January 5).

- Companies choosing the plan of 3 days before Tet and 2 days after Tet:

employees will start the Lunar New Year holiday from Wednesday, February 7, 2024 (December 27, lunar calendar) until the end of Tuesday, February 13, 2024 (January 4).

Thus, employees will have 7 consecutive days off, including 5 days off for the Lunar New Year as regulated by the State and 2 compensatory days off (due to the overlap with regular weekly days off).

*For employees required to work on Saturdays

- Companies choosing the plan of 1 day before Tet and 4 days after Tet:

employees will start the Lunar New Year holiday from Friday, February 9, 2024 (December 30, Year of the Cat) until the end of Wednesday, February 14, 2024 (January 5).

- Companies choosing the plan of 2 days before Tet and 3 days after Tet:

employees will start the Lunar New Year holiday from Thursday, February 8, 2024 (December 28, lunar calendar) until the end of Tuesday, February 13, 2024 (January 4).

- Companies choosing the plan of 3 days before Tet and 2 days after Tet:

employees will start the Lunar New Year holiday from Wednesday, February 7, 2024 (December 27, lunar calendar) until the end of Monday, February 12, 2024 (January 3).
