Based on the provisions of Article 30 of the 2015 Law on Military Service as follows:
Age for conscription
- Citizens aged 18 can be conscripted; the age for conscription is from 18 to the end of 25; citizens who have been trained at the college or university level and have had their conscription postponed may be conscripted until the end of 27.*
Citizens who are 18 years old will be eligible for conscription.
Citizens not trained at college or university level will have the conscription age limit of 25. Citizens trained at college or university level who have had their conscription postponed can be conscripted until the end of 27.
Citizens can apply the following method to determine their age:
Citizens born on a specific day, month, year according to the structure day/month/year can determine their age as follows:
- From 18 years old: Day/month/year + 18.
- End of 25 years old: Day/month/year + 26.
- End of 27 years old: Day/month/year + 28.
A citizen born on 01/01/2005 would be considered 18 years old on January 1, 2023.
Based on the above regulation, we can see that if born in 2005, the time to determine being 18 years old is 2023, the time to determine being 25 years old is 2031, and the time to determine being 27 years old is 2033.
Thus, if not falling under the cases of deferment, those born in 2005 will be conscripted from 2023 to 2031. If they have been trained at college or university level, they will not be conscripted after 2033.

Based on Clauses 1 and 2, Article 4 of the 2015 Law on Military Service stipulating military service as follows:
Military service
- Military service is the honorable obligation of citizens serving in the People's Army. Performing military service includes active-duty service and reserve-duty service in the People's Army.
- Citizens within the age for military service, regardless of ethnicity, social status, belief, religion, educational level, occupation, residence, must perform military service as prescribed by this Law.

Additionally, based on the provisions of Article 6 of the 2015 Law on Military Service stipulating the performance of military service by citizens as follows:
Obligation to serve on active duty
- Male citizens within the age for military service are obliged to serve on active duty in the People's Army.
- Female citizens within the age for military service, if volunteering and the army has a need, are allowed to serve on active duty.
Thus, based on the above regulations, male citizens must perform military service within the prescribed age. In other words, this is a mandatory obligation for male citizens.
For female citizens, the 2015 Law on Military Service expands the regulation, allowing female citizens within the prescribed age, if volunteering and the army has a need, to enlist. This regulation does not mandate that female citizens within the age for military service must enlist. Female citizens in peacetime enlist on a voluntary basis and are accepted by the state.
- The current age for conscription is stipulated in Clause 1, Article 4 of Circular 148/2018/TT-BQP as follows:
+ Citizens from 18 years old to the end of 25 years old.
+ Male citizens who have been trained at college or university level and have had their conscription postponed during one training course of an educational level may be conscripted until the end of 27 years old.
In which cases is one exempted from military service?
Based on the provisions of Clause 1, Article 41 of the 2015 Law on Military Service supplemented by Point c, Clause 1, Article 49 of the 2019 Law on Militia and Self-Defense stipulating the cases of deferment from military service:
- Not healthy enough for active duty according to the conclusion of the Health Examination Council;
- The only laborer directly nurturing non-working dependents or dependents under working age; families seriously affected by accidents, natural disasters, or dangerous epidemics recognized by the commune-level People's Committee;
- An only child of a war invalid or a person with dioxin exposure with a working capacity decrease from 61% to 80%;
- Having siblings serving as non-commissioned officers or soldiers on active duty; having siblings performing obligations in the police force;
- People relocated or resettled in the first three years to especially difficult communes according to the state’s socioeconomic development projects decided by the provincial People's Committee or higher;
- Officials, public employees, and youth volunteers deployed to work in areas with particularly difficult socioeconomic conditions according to the law;
- Studying at general education institutions; being trained at the regular university level belonging to a higher education institution, the regular college level belonging to a vocational educational institution within one training course.
- Permanent militia
Citizens in the above categories will be deferred from conscription in 2024.
In addition, the cases stipulated in Clause 2, Article 41 of the 2015 Law on Military Service exempted from military conscription in 2024 include the following:
- Children of martyrs or first-class war invalids;
- An only sibling of a martyr;
- An only child of a second-class war invalid, an only child of a person with a working capacity decrease over 81%, an only child of a person with dioxin exposure with a working capacity decrease over 81%;
- People in cryptographic work not being soldiers or police officers;
- Officials, public employees, and youth volunteers deployed to work in areas with particularly difficult socioeconomic conditions according to the law for 24 months or more.
In addition, citizens who qualify for deferment according to the above regulation, if the reason for deferment is no longer available, may be conscripted.
Citizens qualified for deferment or exemption from conscription as stipulated, if volunteering, will be considered for conscription.
