Who are the civil servants of the judiciary - civil servants at the commune level in Vietnam?
According to the provisions of Clause 3, Article 4 of the Law on Cadres and Civil Servants 2008, commune-level civil servants who are Vietnamese citizens are recruited to hold a professional title under the commune-level People's Committee, on the payroll and receive salaries from the state budget.
Accordingly, it is possible that according to civil servants, civil servants are holders of professional titles, professional judicial and civil status under commune-level People's Committees.
Specifically, in Clause 6 Article 2 of Circular 13/2019/TT-BNV, the duties of civil servants - civil servants at commune level include:
- Advising and assisting commune-level People's Committees in performing the tasks and powers of commune-level People's Committees in the fields of justice and civil status in their areas in accordance with law.
- Directly perform the following tasks:
+ Legal dissemination and education; managing legal bookcases, building communes that meet legal access standards; organizations serving the people in legal research; monitor the implementation of the law and organize the collection of people's opinions in commune-level areas in participating in law development;
+ Verifying and reviewing legal documents of People's Councils and commune-level People's Committees to report to competent agencies for consideration and decision; participate in the execution of civil judgments in the area;
+ Performing the tasks of judicial work, civil status, attestation, certification and monitoring of nationality and adoption; quantity and quality of population in commune-level areas in accordance with law; coordinate with socio-cultural civil servants in guiding the development of incense and conventions in villages, street groups and educational work in the area;
+ Assume the prime responsibility for, and coordinate with other civil servants in, carrying out mediation work at grassroots level; handle administrative violations, help commune-level People's Committees build and manage databases on civil status in their localities;
- Perform other tasks as prescribed by specialized laws and courtesy of the Chairman of the People's Committee.

Pursuant to Point e, Clause 3, Article 61 of the Law on Cadres and Civil Servants 2008, a commune-level civil servant is a commune-level civil servant title.
According to the provisions of Clause 2, Article 72 of the 2014 Law on Civil Status, civil servants - commune-level civil servants must have the following criteria:
- Have an intermediate level of law or higher and have been trained in civil status;
- Have clear writing and appropriate computer skills according to job requirements.
Based on the actual conditions of the area, population, amount of judicial work and civil status of the locality, the Government shall prescribe the placement of judicial civil servants - civil servants to undertake the task of specialized civil status.
In addition, according to Article 3 of Decree 112/2011/ND-CP, Clause 1 Article 1 of Circular 13/2019/TT-BNV, a number of regulations amended by Article 1 of Circular 04/2022/TT-BNV, civil servants at commune level must also meet the following standards:
- Understanding political theory, mastering the views, guidelines, guidelines of the Party, policies and laws of the State;
- Be capable of organizing people's mobilization in localities to effectively implement the Party's guidelines, policies and laws of the State;
- Have cultural qualifications and professional qualifications suitable to the requirements of tasks, job positions, have sufficient capacity and health to complete assigned tasks;
- Understand and respect the customs and practices of the community in the working area.
- Age: Full 18 years old or older;
- General education level: Graduated from high school;
- Informatics level: Be granted a certificate of using information technology according to basic information technology use skills standards specified in Circular 03/2014/TT-BTTTT.

2. For commune-level civil servants:
Commune-level civil servants who graduated from primary training level or higher in accordance with the expertise of their titles, performed salary classification as administrative civil servants specified in payroll No. 2 (Professional and professional payroll for cadres and civil servants in state agencies), Payroll No. 4 (Payroll of executive employees, serving in state agencies and non-business units of the State) issued together with Decree No. 204/2004/ND-CP
Accordingly, in Clause 1, Article 14 of Circular 2/2021/TT-BNV stipulates that administrative specialized civil servants are entitled to apply Table 2 (Professional and professional payroll for cadres and civil servants in state agencies) Decree 204/2004/ND-CP as follows:
- The rank of Senior Specialists (code 01.001) applies the salary of civil servants of class A3, group 1 (A3.1), from a salary coefficient of 6.20 to a salary coefficient of 8.00;
- The rank of Principal Specialist (code 01.002) applies the salary of civil servants of class A2, group 1 (A2.1), from salary coefficient 4.40 to salary coefficient 6.78;
- Specialist rank (code 01.003) applies the salary table of civil servants class A1, from salary coefficient 2.34 to salary coefficient 4.98;
- Cadre rank (code 01.004) applies the salary of civil servants class A0, from salary coefficient 2.10 to salary coefficient 4.89;
- Employee rank (code 01.005) applies class B civil servant payroll, from salary coefficient 1.86 to salary coefficient 4.06.
Currently, the base salary by the end of 30/6/2023 is 1,490,000 VND (Clause 2 Article 3 of Decree 38/2019/ND-CP). According to Section 3 of Resolution 69/2022/QH15, the base salary from 01/07/2023 is 1.8 million VND.
Thus, the salary of judicial - civil servants has changed when adjusting the base salary increase from 01/07/2023 as follows:
