What are the technical standards for security vehicles of credit institutions and foreign bank branches in Vietnam in 2024?

Pursuant to Article 8 of Circular 23/2023/TT-NHNN, there are regulations on technical standards for security vehicles of credit institutions and foreign bank branches as follows:

- Security motor vehicles shall be fitted with storage compartments for money, valuables, and valuable instruments; firefighting equipment, tracking devices (if any), and seats for escort and guard personnel.

- Storage compartments shall meet technical standards below:

+ In respect of trucks: Storage compartments are in enclosed box shape with 3 layers. The inner and outer layers are of stainless steel or steel treated for rust resistance and of minimum thickness of 1 mm (in respect of outer layer) and minimum thickness of 2 mm (in respect of inner layer); the middle layer is of fire-resistance-rated materials. Doors of storage compartments shall have 1 layer;

+ In respect of other types of vehicles: Storage compartments are in enclosed box shape with 3 layers (not including original vehicle body of manufacturers). The inner and outer layers are of stainless steel or steel treated for rust resistance and of minimum thickness of 1 mm (in respect of outer layer) and minimum thickness of 2 mm (in respect of inner layer); the middle layer is of fire-resistance-rated materials. Doors of storage compartments shall be of 2 layers where the outer layer is original doors of the vehicles. If storage compartments include ports for observation from and to driver’s cabins, the ports shall be of 2 layers: the inner layer consists of vertical steel bars of ɸ12, evenly distributed, and no more than 60 mm apart from one another; the outer layer consists of transparent materials and steel mesh;

+ Doors of storage compartments is firmly hinged, bolted, locked (keys and locks, analog keypads, electronic keypads), and of a dimension convenient for handling.

+ Storage compartments shall be equipped with lights, security alarm devices, fire alarm devices, and surveillance camera (if any).

What are the principles of transport of money, valuable property and valuable papers in the system of the State Bank, branches of foreign banks and credit institutions in Vietnam?

Pursuant to the provisions of Article 17 of Decree 40/2012/ND-CP, the transport of money, valuable property and valuable papers in the system of the State Bank, branches of foreign banks and credit institutions must comply with the following principles:

(1) Having the transport order from competent authorities.

(2) The Money, valuable property and valuable papers must be transported in specialized vehicles or other safe means of transport.

(3) The money, valuable property and valuable papers transported must be sufficiently escorted.

(4) The transport plans and processes must be confidential.

(5) Money, valuable property and valuable papers must be packed and sealed and safely preserved during the transport.

What are the regulations on protection of transport of money, valuable property and valuable papers in Vietnam?

Pursuant to the provisions of Article 19 of Decree 40/2012/ND-CP, the protection of transport is as follows:

- The Ministry of Public Security shall send forces to protect the transport of money, valuable property and valuable papers of the State Bank.

- The checkpoints and mobile patrol teams of law enforcement forces must not stop and check specialized vehicles transporting money, valuable property and valuable papers of the State Bank, branches of foreign banks and credit institutions while they are moving .

- Vehicles transporting money, valuable property and valuable papers of the State Bank are given priority during rush hours, when crossing bridges, on ferries and to enter blocked roads.

- People's Committees at all levels shall cooperate with the State Bank, branches of foreign banks and credit institutions in promptly settling problems arising during the transport of money, valuable property and valuable papers of the State Bank, branches of foreign banks and credit institutions locally.

In addition, Article 56 of Circular 01/2014/TT-NHNN stipulates the responsibilities in protection of the transport as follows:

- Vehicles transporting cash, precious assets or valuable papers of the State Bank protected by an armed police force; it depends on the volume, value and nature of each shipment, banks shall discuss and unify with the police unit to determine the number of guardians. In case of a vehicle, it is required to have at least two polices for protection.

Security forces or police protecting cash, precious assets or valuable papers shall be responsible for: Having plans to protect goods, persons and means from starting receipt of goods until finalizing delivery of goods and returning to the head office safely; complying with regulations in transport as prescribed in this Circular; dealing with specific cases that happen and not letting the vehicle be examined, searched on the way. Where any unsafe case occurs, they shall directly fight and assign members of the team to jointly protect persons, cash, precious assets, valuable papers and means.

- Credit institutions or branches of foreign banks shall stipulate responsibilities in protection or transport of cash, precious assets or valuable papers in their system.

Circular 23/2023/TT-NHNN comes into force from February 12, 2024
