General Standards for Court Clerks as Regulated:

Based on the provisions of Article 3 Decision 1718/QD-TANDTC 2017, the general standards for Court Clerks include:

- Possessing firm political mettle, steadfast adherence to Marxism-Leninism, Ho Chi Minh’s thoughts; thoroughly understanding and complying with the policies and directives of the Communist Party, the legal policies of the State; loyal to the Homeland and the Constitution of the Socialist Republic of Vietnam; protecting justice, the interests of the Homeland, and the People.

- Fully performing the duties of an official as stipulated by law; strictly complying with task assignments from superiors; exemplarily adhering to the internal regulations and rules of the agency, unit, and the regulations of the People's Court.

- Diligent, honest, objective, impartial, and exemplary in executing official duties; adhering to the code of conduct for People's Court officials, courteous, cultured, and standard in communication and service towards the public.

- Having qualities, ethical standards, a healthy lifestyle, modesty, solidarity; diligent, frugal, upright, public-minded without seeking personal gain; not bureaucratic, corrupt, wasteful, or negative.

- Regularly being conscious of cultivating qualities, studying to improve levels, capabilities to ensure the completion of assigned tasks.

Standards for Professional Training of Court Clerks and Principal Court Clerks

Standards for Professional Training of Court Clerks and Principal Court Clerks in 2023:

Based on Section 1 Official Dispatch 78/TANDTC-TCCB 2023, the standards for professional training of Court Clerks and Principal Court Clerks are stipulated as follows:

- Standards for Professional Training of Court Clerks:

+ Officials holding the position of Court Clerk who have not yet received professional training as Court Clerks (priority given to officials recruited in 2022).

+ Officials holding the position of specialist or equivalent (having the same salary grade as specialists such as IT engineers; accountants, etc.), with at least a Bachelor’s degree in law.

+ Officials holding the position of assistant or equivalent (having the same salary grade as assistants such as intermediate accountants; intermediate archivists, etc.), with at least a Bachelor’s degree in law, having held the assistant position for a minimum of 2 years, and having satisfactorily completed tasks in 2022.

- Standards for Professional Training of Principal Court Clerks:

+ Officials who have held the position of Court Clerk or equivalent for at least 8 years, not counting probationary periods, including at least 1 year in the position of Court Clerk (the term “equivalent” within the scope of this document is understood from the time the official has a Bachelor’s degree in law).

+ Have undergone professional training as a Court Clerk.

+ Have been recognized by the agency as satisfactorily completing tasks for at least 1 year (in 2022).

Standards for the Position of Court Clerk as Regulated:

Based on Article 7 Decision 1718/QD-TANDTC 2017, the standards for the position of Court Clerk are as follows:

Responsibilities:

Court Clerk is a judicial officer position requiring basic professional expertise in Court Clerk duties, assigned to People’s Courts at various levels.

Standards of Professional Competence:

- Mastering basic knowledge as prescribed by law concerning Court Clerk duties, procedural processes, and administrative and judicial tasks.

- Proficient in drafting procedural documents in the correct format, process, procedures, and authority.

- Proactively formulating and cooperating with colleagues to implement assigned professional tasks ensuring progress, quality, and efficiency.

- Competent in applying information technology to serve assigned professional tasks.

Standards of Education and Training:

- Holding at least a Bachelor's degree in Law.

- Possessing a foreign language certificate equivalent to level 1 in the Vietnamese language proficiency framework stipulated by Circular 01/2014/TT-BGDDT.

- Possessing an IT certificate meeting the basic information technology skills standards set forth by Circular 03/2014/TT-BTTTT.

Standards for the Position of Principal Court Clerk as Regulated:

Based on Article 6 Decision 1718/QD-TANDTC 2017, the standards for the position of Principal Court Clerk are as follows:

Responsibilities:

A judicial officer position requiring advanced professional expertise in Court Clerk duties, assigned to People’s Courts at various levels.

Standards of Professional Competence:

- Mastering and understanding the system of legal regulations concerning Court Clerk duties, procedural processes, and administrative and judicial tasks.

- Capable of participating in the development of Court Clerk operational processes associated with the task requirements of the People’s Court for submission to competent authorities for consideration and decision.

- Proficient in drafting procedural documents in the correct format, process, procedures, and authority.

- Competent in cooperating with related agencies and units to implement tasks according to assigned authority and responsibility.

- Capable of applying scientific and technical advancements to improve and enhance the quality and efficiency of assigned professional tasks.

Standards of Education and Training:

- Holding at least a Bachelor's degree in Law;

- Possessing a foreign language certificate equivalent to level 2 in the Vietnamese language proficiency framework stipulated by Circular 01/2014/TT-BGDDT.

- Possessing an IT certificate meeting the basic information technology skills standards set forth by Circular 03/2014/TT-BTTTT.
