Criteria for Official Classification and Evaluation of Judges' Outstanding Performance
On what basis are officials of the People's Courts evaluated?
Based on Article 12 of the Regulations issued together with Decision 01/QD-TANDTC in 2019, the content for evaluating officials of the People's Courts are as follows:
Content for evaluating officials
1. Officials are evaluated based on the following content:
a) Compliance with the guidelines, policies of the Communist Party, and laws of the State;
b) Political qualities, ethics, lifestyle, demeanor, and working style;
c) Professional competence and level of expertise;
d) Progress and results of task execution;
e) Sense of responsibility and coordination in task execution;
f) Attitude in serving the people.
2. In addition to the provisions of clause 1 of this Article, leadership and management officials are also evaluated based on the following content:
a) Evaluation criteria framework for leadership and management cadres under Regulation No. 89-QD/TW dated August 4, 2017, of the Central Committee;
b) Results of the activities of the unit assigned for leadership and management;
c) Leadership and management competence;
d) Ability to unify, gather officials.
Officials of the People's Courts are evaluated based on the content mentioned above.

What are the criteria for evaluating officials in the court reaching the level of excellent task completion?
Based on Article 13 of the Regulations issued together with Decision 01/QD-TANDTC in 2019, the criteria for evaluating officials at the level of excellent task completion are as follows:
- Officials without leadership or management positions who meet all the following criteria are evaluated as having excellently completed their tasks:
+ Always exemplary, well complying with the guidelines, policies of the Communist Party, and laws of the State;
+ Possess good political qualities and ethics; have a healthy lifestyle, strictly complying with discipline and order in the unit; devoted, responsible in task execution, and assigned duties;
+ Have professional competence and expertise; closely and effectively coordinate with colleagues, agencies, and related organizations in task execution and duties;
+ Have a proactive and creative spirit in task execution and assigned duties;
+ Have appropriate attitude and cultured behavior in task execution and duties; effectively carry out activities to prevent and combat acts of authority misuse, arrogance, causing difficulties, troubles, negativity, corruption, and waste.
+ Complete 100% of tasks according to the annual work program and plan, ensuring progress, quality, and effectiveness.
Where, judicial title holders must ensure the following standards:
For Judges: No judgments or decisions are annulled or corrected due to subjective causes and do not commit any of the following acts:
- Handle complaints filed to the court beyond the time limit prescribed by law;
- Handle requests to resolve civil cases beyond the time limit prescribed by law;
- Accept cases beyond the time prescribed by law;
- Return complaints, requests for civil case resolutions not conformable to the law, affecting the rights and legitimate interests of agencies, organizations, individuals or causing negative public opinion, affecting the prestige of the People's Court.
- Let cases exceed the time limit for preparation of trial, the time limit for examining request files as prescribed by law without justification.
- Issue decisions to apply emergency measures not conformable to the law or fail to issue decisions to apply emergency measures as prescribed by law.
- Issue judgments, and decisions found to have many errors upon being announced on the People's Courts' electronic portal, causing negative public opinion, and affecting the prestige of the People's Courts.
- The presiding judge of the court hearing does not perform or improperly performs the publication of judgments, decisions on the People's Courts' electronic portal under Resolution 03/2017/NQ-HDTP dated March 16, 2017, of the Judicial Council of the Supreme People's Court.
- Delay in issuing judgments, extracting records, delivering, or sending judgments not conformable to the law.
- Issue decisions to temporarily suspend the trial, resolve cases without legal grounds as prescribed by law.
- Issue judgments of imprisonment with suspended sentences, warnings, fines (main punishment), or non-custodial reform penalties not conformable to the law.
How is the evaluation result of officials in the People's Courts used?
Based on Article 10 of the Regulations issued together with Decision 01/QD-TANDTC in 2019, the provisions on using the evaluation results of officials and public employees, and workers are as follows:
- The evaluation and classification results of officials are used as a basis for arranging, utilizing, appointing, promoting professional title grades, planning, appointing, dismissing, transferring, rotating, training, fostering, rewarding, disciplining, terminating employment, and implementing policies for officials.
- The evaluation and classification results of public employees are used as a basis for continuing to sign work contracts, arranging, utilizing, promoting professional title grades, planning, appointing, dismissing, training, fostering, rewarding, disciplining, and implementing policies for public employees.
- The evaluation and classification results of workers are used as a basis for continuing to sign work contracts, arranging, utilizing, rewarding, disciplining, and implementing policies for workers.
- The evaluation and classification results of officials, public employees, and workers are also used as a reference in evaluating and classifying party members, trade union members, and members of the Ho Chi Minh Communist Youth Union.
