What are the criteria for civil servants in Vietnam to be rotated?

Pursuant to the provisions of 56 Decree 138/2020/ND-CP, the standards for civil servants to be rotated are as follows:

- Have a strong political stance, ideology, good moral qualities.

- In planning, there are development capacity and prospects; always complete the assigned tasks well.

- Basically meeting the specific criteria and conditions of the incoming rotational office.

- Age requirements:

+ The working time is at least two terms (10 years) from the time of rotation;

+ Particularly, civil servants leading and managing rotations to implement the regulations must not allocate local people and to implement the regulations must not hold more than two consecutive terms in a locality, agency, organization or unit, they must have enough working time for at least one term.

- Have sufficient working health.

How long is the assessment of rotating civil servants in Vietnam carried out?

According to the provisions of Article 62 of Decree 138/2020/ND-CP, the following provisions are as follows:

Comments and reviews for rotating civil servants
1. Every 6 months, annually or at the request of competent authorities, party committees, party organizations, collective leaders, heads of agencies and organizations to comment and evaluate incoming civil servants; reporting regulatory authority.
2. When the rotation period expires:
a) Rotating civil servants self-review the work process during the rotation period;
b) Collective leaders and committees of agencies and organizations commenting on and evaluating civil servants who rotate during their working time in localities, agencies and organizations;
c) The competent authority shall decide on the rotation of comments and assessments.

Thus, according to the above provisions, the assessment of rotating civil servants is carried out every 6 months, annually or at the request of competent authorities.

What does the rotating civil servants in Vietnam record include?

Pursuant to the provisions of Article 60 of Decree 138/2020/ND-CP, regulations on transfer of civil servant dossiers made according to Article 48 of Decree 138/2020/ND-CP include:

(1) A written submission on the appointment signed by the head of the agency or organization (in case of submission to a competent superior for decision on appointment); or signed by the head of the agency in charge of organizing cadres (in case the head of the agency or organization decides);

(2) A summary of the vote counting results accompanied by the minutes of the vote counting at the steps of the appointment process;

(3) A curriculum vitae self-declared by the individual in the prescribed form, confirmed by the agency directly managing it, with a 4x6 color photo, taken for a period not exceeding 06 months;

(4) A self-review of the last 3 years of service;

(5) Comments and assessments of leaders of agencies and organizations on moral qualities, lifestyles, sense of discipline, internal solidarity, working capacity, results of performance of functions and tasks in the last 3 years;

(6) Comments by the resident committee on themselves and their families. In case one's place of residence is different from that of the family, he/she must take comments from the branch where he/she resides and where the family resides;

(7) Conclusions of competent commissioners on political standards;

(8) Declaration of assets and income in the prescribed form;

(9) Copies of diplomas and certificates as required by the standard of appointment titles. In case personnel have diplomas issued by foreign educational institutions, they must be recognized in Vietnam according to regulations;

(10) Health certificate issued by a competent medical establishment within 06 months.

What policies are rotational civil servants in Vietnam entitled to?

Pursuant to the provisions of Article 64 of Decree 138/2020/ND-CP, the policies applicable to rotating civil servants are as follows:

- Civil servants who rotate to other positions whose allowance for the new position is lower than the allowance for the position held before the rotation shall be entitled to reserve the allowance for the current position during the rotation period.

- Civil servants who rotate to work in mountainous, border, island, remote, ethnic minority areas, areas with extremely difficult socio-economic conditions are entitled to preferential regimes and policies as prescribed by law.

- Rotating civil servants are entitled to policies on the arrangement of civil service housing, travel assistance, living expenses and other policies (if any).

- Rotating civil servants with exceptionally excellent achievements (having specific initiatives and work products recognized by competent authorities) shall be considered for salary increases ahead of time as prescribed by law; are prioritized when considering post-rotation work arrangements.

Thus, according to the above provisions, rotating civil servants will be entitled to regimes and policies on position allowances; regimes and policies for civil servants to rotate to work in mountainous, border, island, remote, ethnic minority areas, areas with extremely difficult socio-economic conditions.

In addition, rotating civil servants are also entitled to policies on civil service housing arrangement, travel assistance, living expenses and other policies (if any). If rotating civil servants with exceptionally excellent achievements are considered to raise their salaries ahead of time as prescribed by law; are prioritized when considering post-rotation work arrangements.
