Pursuant to Article 20 of Decree 44/2022/ND-CP stipulates as follows:

“Article 20. Information and data processing and storage.
1. Receive and synthesize information and data
The Department of Construction shall receive, synthesize and review information and data specified in Clauses 4, 5, 6, 7, 8, 9, 10, Article 18; The Ministry of Construction shall receive, synthesize, and review information and data specified in Clauses 1, 2, 3, 4, Article 18 in accordance with Clause 2, Article 20 of this Decree.
2. The agency managing the housing and real estate market information system is responsible for processing information and data before integrating and storing them in the database on housing and real estate market to ensure reasonableness and consistency. Information and data processing contents include:
a) Check and evaluate the compliance with regulations and processes in the collection of information and data;
b) Check and evaluate the legal basis and reliability of information and data;
c) Synthesize, arrange and classify information and data in accordance with the prescribed contents;
d) Within 5 working days, the agency managing the housing and real estate market information system at the provincial level must inspect and review reports of agencies and organizations in accordance with regulations of this Decree before sending it to the Ministry of Construction.
3. For updated information and data from a specialized database, the agency managing that specialized database is responsible for ensuring the accuracy of the information and data.
4. Information and data on housing and real estate market must be digitized, archived and preserved in accordance with the law on storage and specialized regulations to ensure safety and convenience in management, exploitation and use of information.
5. Agencies and units assigned to manage the database on housing and real estate market must have a plan to digitize data that is not in digital form; must take management, professional and technical measures for the information system to ensure the safety of information and digital data on housing and the real estate market.”

Accordingly, the content of processing and storing information and data about housing and the real estate market must comply with the above provisions.

What is the time limit for sharing and providing information and data on housing and real estate market of Vietnam?

Pursuant to Article 19 of Decree 44/2022/ND-CP stipulates as follows:

“Article 19. Regime and time limit for sharing and providing information and data on housing and real estate market
1. Mode of sharing, providing information and data:
a) Quarterly forms No. 1, 2; 3; 4; 6; 7; 8; 10; 11; 12; 13;
b) Annually forms No. 5; 9.
2. Time limit for closing data and submitting forms for sharing, providing information and data:
a) The Ministry of Construction receives information and data:
- Quarterly: before the 20th of the last month of the reporting quarter. For Form No. 1 done before the 30th of the first month of the next quarter;
- Annually: before the 20th of the last month of the reporting year;
b) Department of Construction receives information and data:
- Quarterly: before the 10th of the last month of the reporting quarter;
- Annually: before the 10th of the last month of the reporting year;
c) Time limit for data closing: 05 days before the reporting date.”

Accordingly, the time limit for closing data and submitting forms for sharing and providing information and data on housing and the real estate market must comply with the above regulations.

What are the sources of funding for construction, management, operation and use of information systems on housing and real estate market of Vietnam?

Pursuant to Article 21 of Decree 44/2022/ND-CP stipulates as follows:

“Article 21. Ensure funding for construction, management, operation and use of information systems on housing and real estate market
1. State budget funding:
a) The central budget ensures the construction and upgrading of information technology technical infrastructure systems and software systems in service of management, operation and exploitation; investigate, collect information, build a database and maintain regular operation of the central housing and real estate market information system;
b) The local budget ensures the construction and upgrading of the information technology technical infrastructure system in service of operation; investigate, collect information, build a database and maintain regular operation of the information system on housing and real estate market implemented by the locality.
2. Other sources as prescribed by law (if any).
3. The agency managing the housing and real estate market information system is allowed to deduct part of the collected funds benefit from the exploitation of information and data on housing and the real estate market to serve the operation and maintenance of regular operation of the housing and real estate market information system; the appropriation of part of the funding shall comply with the law on state budget.
4. Funds for construction and upgrading of information technology technical infrastructure systems in service of operation; investigate, collect information, build a database and maintain the regular operation of the housing and real estate market information system and the management and use of the proceeds from mining, the use of information and data from the database on housing and the real estate market shall comply with the provisions of the law on state budget; in case the project has used public investment capital from the state budget (if any), the law on public investment shall apply.”

Accordingly, funding for construction, management, operation and use of information systems on housing and real estate market shall comply with the above provisions.

Decree 44/2022/ND-CP will take effect from August 15, 2022.
