Pursuant to Article 21 of Decree No. 68/2015/ND-CP, subsection 7 Section A Part II Administrative procedures promulgated together with Decision No. 1204/QD-BGTVT in 2022, the procedures for deregistration of right to possession towards aircrafts are do the following:

(1) Procedures of execution:

Step 1: Submit administrative documents:

The aircraft owner who requests to remove the registration of possession of the aircraft sends the application file directly, via the postal system or in the electronic environment or by other means to the Civil Aviation Authority of Vietnam and shall be responsible for the accuracy and truthfulness of the information contained in the dossier.

Step 2: Handling administrative procedures:

- Within 03 working days from the day on which the complete application is received, the Civil Aviation Authority of Vietnam shall issue the certificate of de-registration of aircraft possession; revoke the issued certificate of possession of the aircraft, except for the case where the certificate of possession of the aircraft is lost. In case of refusal, the Civil Aviation Authority of Vietnam must reply in writing to the requester, clearly stating the reason.

- In case the dossier is incomplete, within 01 working day from the date of receipt of the dossier, the Civil Aviation Authority of Vietnam shall issue a written instruction to the deregistration requester to complete the dossier as prescribed.

(2) Methods:

- Send resumes directly;

- By postal mail; or

- Online; or

- Other suitable methods.

(3) Time limit for settlement:

- 03 working days from the date of receipt of complete dossiers as prescribed.

(4) Objects of administrative procedures: Persons leasing an aircraft

(5) Agencies carrying out administrative procedures:

- Authority competent to decide: Civil Aviation Authority of Vietnam.

- Authority or authorized person authorized or decentralized to perform: None

- The agency directly carrying out administrative procedures: Civil Aviation Authority of Vietnam.

- Coordinating agency: No

(6) Results of administrative procedures: Certificate of deregistration of right to possession towards aircrafts.

Pursuant to the provisions of Clause 2, Article 21 of Decree No. 68/2015/ND-CP as amended by Clause 3, Article 1 of Decree No. 64/2022/ND-CP as follows:

Procedures for deregistration of right to possession towards aircrafts
2. An application for deregistration of right of possession towards a Vietnamese aircraft shall include:
a) An application form according to Form No. 02 in Appendix enclosed with this Decree;
b) Copies from master registers or certified true copies or photocopies of the originals or copies enclosed with their originals for appraisal purpose or electronic copies from master registers or certified true electronic copies of the originals of documents proving the legal status of the applicant if the applicant is a Vietnamese organization or individual.
If such documents are issued by a competent foreign authority, they shall be consularly legalized as prescribed by law, except for the cases in which consular legalization is exempted according to the international treaty to which the Socialist Republic of Vietnam is a signatory or principles of reciprocity.

Thus, the application for deregistration of right to possession towards aircrafts includes:

- An application form;

- Copies from master registers or certified true copies or photocopies of the originals or copies enclosed with their originals for appraisal purpose or electronic copies from master registers or certified true electronic copies of the originals of documents proving the legal status of the applicant if the applicant is a Vietnamese organization or individual.

How long does it take to carry out the procedures for deregistration of right to possession towards aircrafts in Vietnam?

Pursuant to the provisions of Clause 3, Article 20 of Decree No. 68/2015/ND-CP as amended by Clause 10, Article 1 of Decree No. 64/2022/ND-CP as follows:

Within three (03) working days from the day on which the satisfactory application is received, the Civil Aviation Authority of Vietnam shall issue the Certificate of deregistration of right to possession towards aircrafts according to the Form No. 10 in Appendix enclosed with this Decree and revoke the issued Certificate of registration of right to possession towards aircrafts; if the application is rejected, the Civil Aviation Authority of Vietnam shall send the applicant a written response containing explanation.
If the application is not satisfactory, within one (01) working day from the day on which the application is received, the Civil Aviation Authority of Vietnam shall issue a guiding document for completion according to regulations.

Thus, the time to carry out procedures for deregistration of right to possession towards aircrafts according to regulations is 03 working days from the date of receipt of satisfactory application.
