Based on Article 6 of the Regulation issued with Decision 01/QD-TANDTC in 2019, it is stipulated as follows:

The classification and evaluation of officials and public employees working at the People's Court consist of 4 levels as follows:

Based on Clause 2, Article 7 of the Regulation issued with Decision 01/QD-TANDTC in 2019, the stipulations are as follows:

2. Documentation for recommending the evaluation and classification of officials and public employees, and workers include:
a) A written request for evaluation and classification of officials and public employees, and workers;
b) Minutes of the evaluation and classification meeting.
c) Evaluation and classification forms of officials and public employees, and workers;
d) Written opinions of the executive committee at the workplace and the residence place of officials and public employees holding leadership and management positions.
The documents required to recommend the evaluation and classification of officials and public employees of the People's Court include:
- A written request for evaluation and classification of officials and public employees, and workers;
- Minutes of the evaluation and classification meeting.
- Evaluation and classification forms of officials and public employees, and workers;
- Written opinions of the executive committee at the workplace and the residence place of officials and public employees holding leadership and management positions.
How are the procedures for evaluating officials and public employees of the People's Court at the district level?
Based on Point a, Clause 1, Article 7 of the Regulation issued with Decision 01/QD-TANDTC in 2019, the procedures for evaluating officials and public employees of the People's Court are stipulated as follows:
Step 1: Officials, public employees, and workers create self-assessment reports on work results according to the assigned tasks using the evaluation and classification form in the Appendix;
Officials and public employees holding leadership and management positions: Obtain written evaluation opinions from the executive committee at the workplace and the residence place.
Step 2: Heads of departments subordinate to units of the Supreme People's Court; Courts, departments under the High People's Court; Courts, departments under the provincial and municipal People's Courts; Courts, departments under the district-level People’s Courts; Chief Judges of district-level People’s Courts without specialized courts preside over general meetings of officials, public employees, and workers of the unit to comment on the content of the evaluation and classification forms of officials and public employees, and workers. Comments are recorded in the minutes and approved at the meeting.
Step 3: Heads of units: Courts, departments under the district-level People’s Courts; Chief Judges of district-level People’s Courts without specialized courts, based on the comments from Step 1 and Step 2, prepare the documentation recommending the evaluation and classification of officials and public employees, and workers of their respective units to report to the Supreme People’s Court unit heads/Chief Judges of the High People’s Courts/Chief Judges of provincial and municipal People’s Courts/Chief Judges of district-level People’s Courts for evaluation and classification (through the section assigned to support the work of evaluating and classifying officials and public employees, and workers of units under the Supreme People’s Court; the Organizational-Personnel, Inspection, and Emulation-Commendation Department of the High People’s Courts, provincial and municipal People’s Courts; the Office under the district-level People's Courts) before December 5 each year.
Step 4: Heads of units under the Supreme People’s Court, Chief Judges of the High People’s Courts, Chief Judges of provincial and municipal People’s Courts, Chief Judges of district-level People’s Courts, based on the evaluation and classification documentation, evaluate according to authority and announce the evaluation and classification results for leaders, officials, and public employees before December 10 each year.
What are the principles for evaluating and classifying officials and public employees of the district-level People’s Court?
Based on Article 3 of the Regulations issued with Decision 01/QD-TANDTC in 2019, the stipulations are as follows:
- The head of the unit has the authority to evaluate and simultaneously classify officials and public employees, and workers and is responsible for their decisions.
- The evaluation must be based on the responsibilities and assigned tasks and the results of task performance, accounting for the proportion of work volume completed by officials and public employees, and workers compared to the overall work volume of the unit. It is necessary to clarify the merits, shortcomings, deficiencies, and limitations in qualities, capacities, and levels of officials and public employees, and workers.
- Evaluation and classification of officials and public employees holding leadership and management positions must be based on the performance results of the units they are assigned to lead and manage. The level of task completion of the unit head must not be higher than the task completion level of the unit.
- In cases where officials and public employees, and workers do not complete tasks due to objective, unavoidable factors, these shall be considered in the evaluation and classification process.
- Ensure openness, transparency, and democracy.
