Procedure for registering birth combined with registering parentage recognition starting from April 2023

Based on Subsection 4, Section B, Part B of Administrative Procedures issued together with Decision 528/QD-BTP in 2023, the procedure for registering birth combined with registering parentage recognition is as follows:

- The individual requesting birth registration and parentage recognition submits the birth registration and parentage recognition dossiers to the One-Stop Division of the competent commune-level People's Committee; pays the fee if the birth registration, parentage recognition fee is applicable; and pays the fee for issuing copies of the Birth Certificate or Extract for parentage recognition if required.

- The officer receiving the dossier at the One-Stop Division is responsible for checking the accuracy, completeness, consistency, and validity of the dossier.

(i) If the dossier is complete and valid, accept the dossier, issue an appointment slip, and deliver the result to the requester while transferring the dossier to the official handling civil status.

After receiving the dossier, the officer at the One-Stop Division digitizes it (copies and converts into electronic documents on the information system, database), and signs the digitized administrative procedure documents and files as per regulations.

(ii) If the dossier is incomplete or invalid, notify the requester to supplement and complete the dossier, clearly specifying the type of documents and contents to be supplemented. Once supplemented, repeat step (i);

(iii) If the requester for birth registration and parentage recognition fails to supplement or complete the dossier, report to the Head of the One-Stop Division to issue a notice of refusal to process the request for birth registration and parentage recognition.

- The justice-civil status officer verifies the dossier (verifies the consistency and validity of the information within the dossier, documents, and materials submitted or presented by the requester).

+ If the dossier requires supplementation, completion, or fails to meet the conditions for resolution, a status update on the dossier will be sent to the One-Stop Division to notify the dossier submitter – repeat step (ii) or (iii);

+ If verification or clarification is needed or due to other reasons that prevent providing results on the appointed date, the justice-civil status officer issues an apology slip and reschedules the result delivery date, clearly stating the reason for the delay and the new appointment time, forwarding it to the One-Stop Division for delivery to the requester;

+ If it is verified that parentage recognition is legitimate and undisputed, with complete and appropriate birth information, the justice-civil status officer records it in the Parentage Recognition Register, Birth Registration Book, updates the birth registration and parentage recognition information, and formally stores it in the shared electronic civil status management software, forwarding the information to the National Population Database (CSDLQGVDC) to obtain a personal identification number.

- After CSDLQGVDC returns the personal identification number, the justice-civil status officer prints the Birth Certificate, Extract for parentage recognition, submits them to the Leader of the People's Committee for signing, and transfers the results to the One-Stop Division for delivery to the requester.

- The requester for birth registration and parentage recognition (both parties must be present, present identification documents for comparison) checks the information on the Parentage Recognition Extract, Birth Certificate, in the Parentage Recognition Register, Birth Registration Book, and signs in the Parentage Recognition Register, Birth Registration Book, receiving the Parentage Recognition Extract, Birth Certificate.

Documents required for registering birth combined with registering parentage recognition

Based on Subsection 4, Section B, Part B of Administrative Procedures issued together with Decision 528/QD-BTP in 2023, the procedure for registering birth combined with registering parentage recognition is as follows:

Documents to be submitted:

- Birth registration application form;

- Parentage recognition application form;

- The original Birth Certificate; in the absence of a Birth Certificate, submit a document from a witness confirming the birth; if no witness is available, a written statement about the birth is required;

- Evidence proving the parent-child relationship, including:

+ Documents from medical authorities, forensic examination agencies, or other competent authorities confirming the parent-child relationship.

+ If the above documents are not available, the parties acknowledging the parentage shall make a written statement about the parent-child relationship, with at least two witnesses on the parent-child relationship.

Documents to be presented:

- Passport or Identity Card or Citizen Identification Card or other documents with a photo and personal information issued by a competent authority, valid for identifying the person requesting birth registration and parentage recognition;

- Documents proving residence information if the civil registration authority cannot access the information on the citizen's residence. If information on residence proof documents is retrieved from the National Population Database through these means, the requester is not required to present (in-person) or upload (online).

Notes:

- For documents to be submitted or presented:

+ The recipient is responsible for verifying, comparing with the information in the application, taking photos or recording information to file in the dossier, and returning the original documents to the presenter, without requiring submission of copies or photographs of those documents.

+ The requester may submit a certified copy from the original or a copy issued from the original record or a photocopy accompanied by the original for comparison. If the requester submits a photocopy attached to the original document, the recipient is responsible for verifying and comparing the photocopy with the original and signing the confirmation without requiring the requester to submit a copy of the document.

+ The recipient is responsible for receiving the full and correct civil status registration dossier according to civil status law regulations and should not require the requester to submit additional documents not stipulated by civil status law.

- In cases allowing the requester to make a written statement about the content of the civil status registration request, the civil status registration authority must clearly explain the responsibility and legal consequences of a false statement.

The civil status registration authority will refuse to process or advise a competent authority to cancel the civil status registration result if there are grounds to determine that the content of the statement is false.

- For the determination of a child's surname, ethnicity, birthplace, and naming:

+ The determination of a child's surname, ethnicity, and naming must comply with the law and preserve the ethnic identity, customs, and good cultural traditions of Vietnam; names that are too long or difficult to use should not be chosen.

+ If parents cannot agree on the child's surname, ethnicity, or birthplace when registering the birth, the child's surname, ethnicity, and birthplace will be determined according to customs but must comply with either the father's or mother's surname.

Time frame for processing procedures for registering birth combined with registering parentage recognition

Based on Subsection 4, Section B, Part B of Administrative Procedures issued together with Decision 528/QD-BTP in 2023, the processing time for registering birth combined with registering parentage recognition is clearly stated to be 03 working days.
