Pursuant to subsection 2, Section B, Part II, Administrative procedures promulgated together with Decision No. 528/QD-BTP in 2023, stipulating how to carry out the procedures for marriage registration as follows:

The person who requests for marriage registration shall carry out the procedures for marriage registration in one of the following two ways:

- Submit application directly at the Single-window section of the Commune People's Committee

- Submit the application online on the National Public Service Portal (https://dichvucong.gov.vn) or the Provincial-level Public Service Portal (https://dichvucong.---.gov.vn).

Note: The male or female party can submit the application without the written authorization of the other party.

What are the procedures for marriage registration in Vietnam applied from April 10, 2023?

Pursuant to subsection 2, Section B, Part II, Administrative procedures promulgated together with Decision No. 528/QD-BTP in 2023, stipulating the order of carrying out procedures for marriage registration as follows:

Step 1: Submit the application

- If direct application is selected, the person who requests for marriage registration shall submit the marriage registration dossier at the Single-window section of the competent commune-level People's Committee; pay fees if they are required to pay fees for marriage registration; pay the fee for issuance of a copy of the Marriage Extract if there is a request for a copy of the Marriage Extract.

- If you choose to submit an online application, the person who requires marriage registration access the National Public Service Portal or the Provincial Public Service Portal, register an account (if you do not have an account), authenticate users according to instructions, log in to the system, properly identify the competent commune-level People's Committee.

Persons who request online marriage registration provide information in an interactive electronic form for marriage registration (provided on the Public Service Portal), attaching a photocopy or electronic copy of papers and documents according to the law; pay fees and charges through the online payment function or by other methods as prescribed by law, complete the application.

Step 2: Receipt of application

The dossier-receiving officer at the One-Stop-Shop is responsible for checking the accuracy, completeness, consistency and validity of the dossier.

(i) If the application is complete and valid, receive the application, have an appointment slip, return the results to the requester (if the requester chooses the direct form of application) or immediately send the Appointment Form, return the results by email or send an appointment text message via mobile phone to the requester (if the requester chooses to submit the application online), transfer the dossier to civil status civil servants for processing.

(ii) In case the dossier is incomplete or invalid, a notice shall be sent to the requester for supplementation or completion of the dossier, clearly stating the types of papers and contents to be supplemented so that the requester can supplement and complete the dossier. After the records are added, repeat step (i);

(iii) In case the person requesting marriage registration fails to supplement or complete the dossier, it shall report to the Head of the one-stop shop for a notice of refusal to handle the marriage registration request.

Step 3: Verify the application

- Judicial and civil status civil servants verify dossiers (verify the consistency and validity of information in dossiers, papers and attached documents).

+ In case the dossier needs to be supplemented, completed or is not eligible for settlement and must be rejected, a notice of the status of the application should be sent to the Single-window section to notify the applicant - repeat step ( ii) or (iii);

+ In case it is necessary to check, verify, clarify or due to other reasons, the result cannot be returned on time, the civil status officer shall make an apology slip and reschedule the result return date, in which: clearly state the reason for the delay in returning the results and the appointment time to return the results, transfer the Single-window section to pay the requester (if the requester chooses to submit the application directly), or send an apology note and reschedule the return date by email or text message via mobile phone to the requester (if the requester chooses to submit the application online).

+ If the application is found to be complete and valid, the parties are eligible for marriage as prescribed by the Law on Marriage and Family, not in the case of refusal to register their marriage as prescribed, in case of receiving marriage registration dossiers directly, the judicial - civil status officer shall record them in the marriage registration book, update marriage registration information and officially save it on the shared electronic civil status management and registration software.

In case of receiving marriage registration documents online, the civil status - judicial officer shall return the electronic marriage certificate form with complete information to the requester via email or digital device.

The requester is responsible for checking the accuracy and completeness of the information on the electronic marriage certificate form and certifying it (maximum one day).

If the requester for confirmation of the agreed, complete information or has no response after the time limit for requesting, the judicial - civil status officer shall record the contents in the marriage registration book, update the information. Register your marriage and officially save it on the shared electronic civil status management and registration software.

Step 4: Return the result

- Civil status - judicial officer prints the Marriage Certificate, submits it to the Leader of the People's Committee for signature, and forwards it to the One-Stop-shop Division to return the results to the requester.

- The person who requests for marriage registration (both male and female parties must be present and present their identification papers for comparison) check the information on the marriage certificate, in the marriage register, confirm the voluntary marriage and sign the marriage register, sign the marriage certificate, each male and female party will receive 01 original marriage certificate.

What documents must be prepared when carrying out the procedures for marriage registration in Vietnam?

Pursuant to subsection 2, Section B, Part II, Administrative procedures promulgated together with Decision No. 528/QD-BTP in 2023, stipulating the composition of documents prepared for procedures for marriage registration as follows:

- Marriage registration declaration form, with sufficient information of both male and female parties. Both men and women can jointly declare in a marriage registration declaration (if the requester chooses to submit the application directly);

- An interactive electronic form for marriage registration (by the requester providing information according to the instructions on the Public Service Portal, if the requester chooses to submit the application in the online form);

- The person requesting marriage registration shall submit/present (in person) or upload (online form) the following documents:

Documents to be submitted:

- The original of the certificate of marital status issued by the competent commune-level People's Committee in case the marriage registration requester does not register his/her permanent residence in the commune, ward or township where the registration procedures are carried out. In case the information on marital status is already in the National Database, the electronic database is automatically filled in, it does not have to be presented (in the face-to-face form) or uploaded (in the online form).

Documents to be presented:

- Passport or ID card or citizen identification card or other papers with photos and personal information issued by a competent authority, valid for use to prove the identity of the lover birth registration request. In case the personal information in these documents is already in the National Database, the electronic database, which is automatically filled in by the system, it is not required to upload it (in the online form);

- Valuable papers to prove information about residence in case the civil status registration agency is unable to extract information about the citizen's place of residence. In case the information on documents proving residence has been extracted from the National Population Database by these methods, the requester is not required to present (in direct form) or download up (in online form);

- Extract from divorce notes for cases where Vietnamese citizens registered their permanent residence in the commune to carry out procedures for marriage registration, and their previous divorce or marriage annulment has been resolved at a foreign competent authority.

Note:

- For submitted documents, to present if the requester submits the dossier in person:

+ The recipient is responsible for checking, comparing with the information in the declaration, taking pictures or recording the information to save in the file and return it to the presenter, copies or photocopies of such documents are not required.

+ The civil status registration requester may submit a certified true copy from the original or a copy issued from the original book or a photocopy enclosed with the original papers for comparison. In case the requester submits a photocopy enclosed with the original document, the recipient is responsible for checking and comparing the photocopy with the original and signing for certification.

+ The recipient is responsible for properly and fully receiving civil status registration dossiers in accordance with the civil status law, and must not require civil status registrants to submit additional papers that are not required by civil status law to submit.

- For attached documents if the requester submits the application online:

+ Photocopies of documents enclosed with online marriage registration dossiers must be clear, adequate, and complete in terms of content, are photocopies taken with a camera, phone or taken, scanned by an electronic device, from a validly issued document that is still valid for use.

+ In case the papers and documents that must be enclosed in the online marriage registration dossier already have an electronic copy or have an electronic copy of the civil status paper, the requester may use this electronic copy.

+ When going to the civil status registration office to receive the results (original marriage certificate / copy of the marriage extract), the person who requests for marriage registration must submit the original certificate of marital status (if information on marital status is not available in the National Database on population, the electronic civil status database).

- Papers issued, notarized or certified by a competent authority of a foreign country for use in civil status registration in Vietnam must be consularly legalized in accordance with law, except for cases exempted under international treaties to which Vietnam is a signatory

- In case the marriage registration requester fails to provide the above-mentioned papers as prescribed, or the submitted or presented papers are erased, modified or forged, the civil status registration agency has the authority to cancel the results of marriage registration.
