What does the application dossier for the Issuance of a Notary Card include?

Based on the regulations at Subsection 1, Part 2 of the Administrative Procedures issued together with Decision 706/QD-BTP in 2023, the application dossier for the issuance of a Notary Card includes:

- An application for practice registration and issuance of a Notary Card according to Form TP-CC-06 issued together with Circular No. 01/2021/TT-BTP dated February 3, 2021, of the Minister of Justice detailing some provisions and measures for the implementation of the Notary Law;

- Decision on appointment or reappointment of a notary (certified copy or a photocopy accompanied by the original for comparison);

- 01 portrait photo size 2cm x 3cm of the notary proposed for practice registration and card issuance (photo taken not more than 06 months before the submission date);

- Documents proving the notary is a member of the local Notary Association or a member of the Vietnam Notary Association;

- Documents proving the residence of the notary in the province or central city where the notary practice organization registers to operate;

- Decision to revoke the lawyer's practice certificate, the auctioneer's practice certificate, the decision to dismiss the bailiff, documents proving the termination of other regular work; documents proving that the Department of Justice has deregistered the notary practice at the previous notary practice organization or a declaration of commitment that the notary has not registered for practice since being appointed or reappointed as a notary.

Note: For information on proof of residence, officials, public employees, and individuals assigned the responsibility to receive, resolve administrative procedures, and provide public services, shall access residence information of citizens in the National Database on Population by one of the methods specified in clause 2, Article 14 of Decree 104/2022/ND-CP dated December 21, 2022 of the Government of Vietnam amending and supplementing several provisions of the decrees related to the application, presentation of household registration books and temporary residence books in administrative procedures and public service provision.

In case information on the residence of citizens cannot be accessed by the methods stated in clause 2, Article 14 Decree 104/2022/ND-CP, competent authorities, officials, public employees, and individuals assigned the responsibility to receive, resolve administrative procedures, and provide public services may request citizens to submit copies or present one of the papers proving residence information as specified in clause 3, Article 14 of Decree 104/2022/ND-CP.

The types of documents proving residence information are specified in clause 4, Article 14 of Decree 104/2022/ND-CP including:

- Citizen Identification Card,- Identification Card,- Certificate of residence information,- Notice of personal identification number and citizen information in the National Database on Population.

- The notary practice organization submits the application for practice registration and Notary Card issuance to the Department of Justice where it registers its operations;- The Department of Justice issues a decision for practice registration and Notary Card issuance; in case of refusal, it must notify in writing stating the reason.

Note: The fee is 100,000 VND per application.

How long until an individual is issued a Notary Card?

According to the regulations at Subsection 1, Part 2 of the Administrative Procedures issued together with Decision 706/QD-BTP in 2023, within 07 working days from the date of receipt of a complete and valid application, the Department of Justice shall issue a decision for practice registration and Notary Card issuance.

In case of refusal to issue a Notary Card, it must notify in writing stating the reason.
