Pursuant to the provisions of Article 18 of Decree 07/2016/ND-CP on cases for reissuing a license to establish a branch of a foreign trader as follows:
Cases for reissuing a license to establish a representative office, license to establish a branch
Foreign traders shall proceed with procedures for reissuing a license to establish a representative office, license to establish a branch in the following cases:
1. Transferring the location of the representative office's headquarters from one province or centrally-run city, or geographical area under the management of one Management Board to another province or centrally-run city or geographical area under the management of another Management Board.
2. The license to establish a representative office, license to establish a branch is lost, damaged, destroyed, or destroyed by any means.
Thus, based on the above provisions, in the case where the license to establish a branch is lost, damaged, destroyed, or destroyed by any means, the foreign trader is entitled to carry out procedures for reissuing the license to establish the branch.

According to Clause 2, Article 19 of Decree 07/2016/ND-CP, the dossier for reissuing a license to establish a branch of a foreign trader is stipulated as follows:
Dossier for reissuing a license to establish a representative office, license to establish a branch
1. In the case of reissuing as specified in Clause 1, Article 18 of this Decree, the dossier includes the following documents:
a) An application for reissuing the license to establish the representative office in accordance with the form of the Ministry of Industry and Trade, signed by the authorized representative of the foreign trader;
b) A notification of the termination of the representative office's operations sent to the licensing authority at the transfer-out location, as stipulated at Point a, Clause 1, Article 36 of this Decree;
c) A copy of the granted license to establish the representative office;
d) Documents regarding the proposed location for the representative office's headquarters at the new location, as stipulated at Point e, Clause 1, Article 10 of this Decree.
2. In the case of reissuing as specified in Clause 2, Article 18 of this Decree, the dossier includes: An application for reissuing the license to establish the representative office, license to establish the branch in accordance with the form of the Ministry of Industry and Trade, signed by the authorized representative of the foreign trader.

What is the procedure for reissuing a license to establish a branch of a foreign trader?
Pursuant to the provisions of Article 20 of Decree 07/2016/ND-CP, the procedure is stipulated as follows:
Procedure for reissuing a license to establish a representative office, license to establish a branch
1. Foreign traders shall proceed with procedures for reissuing a license to establish a representative office in the cases specified in Clause 1, Article 18 of this Decree within 30 days from the date of notification of termination of the representative office's operations at the transfer-out location. Beyond this period, foreign traders must carry out procedures for issuing the license to establish a representative office as stipulated in Article 10 and Article 11 of this Decree.
2. Foreign traders shall submit the dossier directly, by post, or online (if eligible) to the Licensing Authority.
3. Within 03 working days from the date of receipt of the dossier, the Licensing Authority shall check and request supplementation if the dossier is incomplete or invalid. The request for dossier supplementation shall be made only once during the dossier examination process.
4. Within 05 working days from the date of receipt of a complete and valid dossier, the Licensing Authority shall reissue the license to establish the representative office, license to establish the branch. If the license is not reissued, a written explanation must be provided.
