Conditions for Issuing a Certificate of Eligibility for Technical Inspection of Occupational Safety

Based on Article 4 of Decree 44/2016/ND-CP amended by Clause 1, Article 1 of Decree 140/2018/ND-CP, the provisions are as follows:

Conditions for Issuing a Certificate of Eligibility for Technical Inspection of Occupational Safety

1. An organization that is issued a Certificate of Eligibility for Technical Inspection of Occupational Safety must meet the following conditions:

a) Ensure equipment and tools for inspection for each object within the inspection scope, in accordance with inspection procedures and national technical standards on occupational safety and hygiene.

b) Have at least 02 inspectors working under a contract of 12 months or more for each object within the scope of the application for the Certificate of Eligibility for Technical Inspection.

c) The person in charge of the technical inspection activities of the organization must have at least 02 years of experience as an inspector.

2. The equipment and personnel mentioned in points a, b, and c of Clause 1 of this Article can only be used to apply for a Certificate of Eligibility for Technical Inspection of Occupational Safety for one organization.

According to the provisions of Section 4, Part I of the Appendix issued with Decision 1549/QD-LDTBXH 2023, the procedure for re-issuance of the Certificate of Eligibility for Technical Inspection of Occupational Safety in case the Certificate is lost or damaged is as follows:

- Step 1: Receive the application for re-issuance of the Certificate of Eligibility for Technical Inspection of Occupational Safety

The organization needing re-issuance submits 01 set of application documents for re-issuance of the Certificate of Eligibility for Technical Inspection of Occupational Safety to the Department of Occupational Safety, Ministry of Labor - Invalids and Social Affairs.

- Step 2: Conditions assessment

The receiving agency assesses the conditions based on the application documents.

- Step 3: Issue or refuse to issue the Certificate

No later than 30 days from the receipt of a complete and valid application, the Director of the Department of Occupational Safety will sign under the authorization of the Minister for the Certificates of Eligibility for Technical Inspection. In case of non-issuance, the Director of the Department of Occupational Safety will sign under the authorization of the Minister for the refusal letter stating the reasons for non-issuance.

Application Documents for Re-issuance of the Certificate of Eligibility for Technical Inspection of Occupational Safety when the Certificate is Lost or Damaged

Based on Section 4, Part I of the Appendix issued with Decision 1549/QD-LDTBXH 2023, the provisions are as follows:

4.3. Composition and quantity of application documents:

- Application for re-issuance of the Certificate (01 copy);

- The issued Certificate in case it is damaged.

4.4. Processing time: No more than 30 days (from the receipt of a complete and valid application).

4.5. Subjects of administrative procedures: Inspection organizations that have lost or damaged the Certificate of Eligibility for Technical Inspection of Occupational Safety.

4.6. Administrative procedure execution agency: Ministry of Labor - Invalids and Social Affairs.

4.7. Result of administrative procedure execution: Certificate of Eligibility for Technical Inspection of Occupational Safety or a refusal letter stating the reasons for non-issuance.

- Application for re-issuance of the Certificate (01 copy);

- The issued Certificate in case it is damaged.

The inspection organization that has lost or damaged the Certificate of Eligibility for Technical Inspection of Occupational Safety can submit the application through the online public service portal, postal service, or directly.

The processing time is no more than 30 days from the receipt of a complete and valid application.
