Procedure for Issuing Certificates of Eligibility to Operate Sports Activities for the Sport of Shooting
On March 28, 2024, the Ministry of Culture, Sports and Tourism issued Decision 775/QD-BVHTTDL 2024 announcing the revised and supplemented administrative procedures in the field of physical education and sports under the management of the Ministry of Culture, Sports and Tourism.
According to Section 27, Part II of Decision 775/QD-BVHTTDL 2024, the procedures for issuing certificates of eligibility to operate sports activities for the sport of shooting are as follows:
- Enterprises shall submit their dossiers via postal service, electronically, or directly to the specialized agency for physical education and sports under the Provincial People's Committee where the business location for sports activities is registered or where the enterprise has its headquarters if the enterprise has multiple business locations.
- The specialized agency for physical education and sports under the Provincial People's Committee (hereinafter referred to as the Certificate Issuing Authority) shall issue a receipt for the dossier to the enterprise.
- In case the dossier needs to be amended or supplemented, the Certificate Issuing Authority shall notify the enterprise directly or in writing of the necessary amendments or supplements within 3 working days from the date of receipt of the dossier.
Procedure for Issuing Certificates of Eligibility to Operate Sports Activities for the Sport of Shooting
What should the application dossier for obtaining a certificate of eligibility to operate the sport of shooting include?
According to Decision 775/QD-BVHTTDL 2024, the dossier for obtaining a certificate of eligibility to operate sports activities for the sport of shooting includes the following components:
- Application for certifying the eligibility to operate sports activities
- A copy of the business registration certificate
- A summary of the preparation status for business conditions
What conditions must be met to obtain a certificate of eligibility to operate a shooting sport business?
According to Section 27, Part II of Decision 775/QD-BVHTTDL 2024, the requirements and conditions for organizations applying for a certificate of eligibility to operate sports activities in the sport of shooting are specified as follows:
(1) Facilities and training equipment
- Must meet the following general regulations:
+ Have a wall enclosing the shooting range at least 20cm thick and over 03m high;
+ General lighting of at least 500 lux, target area lighting of at least 1,500 lux;
+ Have a warehouse, place to store sports guns and ammunition that meets the legal standards;
+ Have an area for checking training and competition equipment;
+ The shooting range must have parallel shooting and target lines, with a separate walkway from the shooting line to the target line with a safety partition at least 02cm thick and 02m high;
+ The spectator area is located behind the shooting line, at least 05m from the shooting line;
+ Have a logbook to track the use of sports guns and ammunition according to Appendix I issued with this Circular;
+ Have a logbook to track participants' training according to Appendix II issued with this Circular;
+ Have a first aid kit as regulated by the Ministry of Health;
+ Have instructions on how to use sports guns; have internal regulations including the following key contents:
++ Quotation of legal regulations regarding the responsibilities of trainees, trainers, and other individuals related to the use and maintenance of sports guns;++ Training participants allowed to use sports guns, training hours, training attire.
Participants are allowed to use sports guns in accordance with the Law on Management, Use of Weapons, Explosives, and Supporting Tools.
- For a 50m shooting range:
+ The shooting range must be at least 60m long; designed length consisting of 50m (with at least 35m outdoor or vacant) + 02m target line + 05m shooting line + spectator area; total width not less than 15m, accommodating at least 10 shooting bays;
+ Bullet traps or bullet shields are placed directly behind the targets, made of steel.
- For a 25m shooting range:
+ The shooting range must be at least 35m long; designed length consisting of 25m (with at least 12.5m outdoor or vacant) + 03m target line + 05m shooting line + spectator area; total width not less than 15m;
+ Solid or gutter bullet traps placed parallel and 01m behind the target frame;
+ Bullet shell nets installed in front of the shooter.
- For a 10m shooting range for air guns: Each side of the shooting range no less than 20m in size; designed length consisting of 10m + 20cm target line + 05m shooting line + spectator area; width accommodating 10 shooting bays, each 01m wide and 01m apart.
- For a 10m shooting range for moving targets: The shooting range must be at least 20m long; designed length consisting of 10m + 02m target line + 05m shooting line + spectator area; width at least 10m, divided into 02 separate bays, each 03m wide.
- For a clay pigeon shooting range:
+ The shooting range size must be at least 150m each side;
+ Safety netting 03m high installed above the boundary walls;
+ Ensure a minimum distance of 70m from the firing line to the boundary wall;
+ Fences at least 07m from the rear barriers to separate spectators and the shooting area.
- For a paintball shooting range:
+ The shooting range size must be at least 100m each side;
+ Inside the range, there must be at least 03 targets made of one of the following materials: earth, wood, plastic.
(2) Facilities and equipment for competition
- Follow the above regulations for: Boundary walls, lighting, warehouse and storage for guns and ammunition, equipment check area, shooting range, spectator area, logbooks for tracking gun and ammunition use, first aid kits; shooting ranges for 50m, 25m, and 10m air rifles and moving targets; clay pigeon shooting ranges; and paintball shooting ranges.
- Provide at least 20 shooting bays for each of the 50m, 25m, and 10m ranges.
- Provide at least 02 shooting frames for 10m mobile air rifle ranges.
(3) Training density, training guidance
- Ensure a training density of at least 1 person per 1m2 of shooting position.
- Each trainer may guide no more than 10 people per session.
(4) Specialized staff
- Have staff and specialized personnel suitable for the activities.
- Specific conditions for enterprises operating sports activities requiring trainers:
+ Household businesses and other organizations wanting to operate sports activities requiring trainers must register to establish an enterprise.
+ Enterprises operating sports activities, if providing training services or sports activities within the list of compulsory guided sports activities defined by the Minister of Culture, Sports and Tourism, must meet the following conditions:
The specialized staff includes:
++ Training instructors must meet one of the following conditions:++ Be a coach or athlete of level 2 or higher or equivalent, suitable for the sports activities registered for business;++ Have a degree in physical education from intermediate level or higher, suitable for the sports activities registered for business;++ Be trained in sports according to the regulations of the Minister of Culture, Sports and Tourism.
Therefore, organizations applying for a certificate of eligibility to operate sports activities for shooting must follow the administrative procedures and methods outlined above to be considered for issuance of the certificate.
