Circular 19/2023/TT-BYT guides the list of job positions, job descriptions, and the competency framework of professional public service positions in the healthcare sector.
Circular 19/2023/TT-BYT applies to administrative agencies and organizations performing the function of advising state management in the healthcare sector from central to local levels, including:
- Administrative agencies and organizations under the Ministry of Health and administrative agencies and organizations under other ministries and equivalent agencies that assist the Ministers and Heads of equivalent agencies in state management of the healthcare sector.
- Specialized agencies performing the function of advising and assisting provincial-level People's Committees in managing state healthcare.
- Specialized agencies performing the function of advising and assisting district-level People's Committees in managing state healthcare, including districts, urban districts, district-level towns, provincial cities, and centrally run cities.

What are the principles for determining healthcare-related professional public service job positions?
According to Article 3 of Circular 19/2023/TT-BYT, the principles and bases for determining healthcare-related professional public service job positions are as follows:
Principles and bases for determining healthcare-related professional public service job positions
1. The principles for determining healthcare-related professional public service job positions are to be implemented as stated in Article 3 of Decree No. 62/2020/ND-CP dated June 01, 2020, of the Government of Vietnam on job positions and public servant staffing (hereinafter abbreviated as Decree No. 62/2020/ND-CP).
2. The bases for determining healthcare-related professional public service job positions are as stated in Clause 1, Article 4 of Decree No. 62/2020/ND-CP.
3. The determination of job positions ensures no increase in the approved public servant staffing.
As per Article 3 of Decree 62/2020/ND-CP, the principles for determining job positions and managing public servant staffing are as follows:

1. Comply with the regulations of the Communist Party and the law on job positions, management, and use of public servant staffing.
2. Align with the functions, tasks, authorities, and organizational structure of the agency or organization.
3. Ensure consistency and synchronization between job position determination, public servant classification structures with the use and management of public servant staffing.
4. Ensure scientific, objective, public, transparent, democratic principles, and conformity with practical requirements.
5. Link staff streamlining with restructuring and improving the quality of the public servant team in agencies and organizations.
Accordingly, the determination of healthcare-related professional public service job positions must comply with the following principles:
- Comply with the regulations of the Communist Party and the law on job positions, management, and use of public servant staffing.
- Align with the functions, tasks, authorities, and organizational structure of the agency or organization.
- Ensure consistency and synchronization between job position determination, public servant classification structures, and the use and management of public servant staffing.
- Ensure scientific, objective, public, transparent, democratic principles, and conformity with practical requirements.
- Link staff streamlining with restructuring and improving the quality of the public servant team in agencies and organizations.

Are healthcare-related professional public servants holding higher public servant grades eligible for retention?
According to Article 6 of Circular 19/2023/TT-BYT:
Transitional provisions
For healthcare-related professional public servants holding higher public servant grades (including public servants recognized for passing the examination or considering promotion to a higher grade before this Circular takes effect) compared to the public servant grades required for the job positions regulated in this Circular, retention is maintained until new salary policy guidelines are issued.
Thus, healthcare-related professional public servants holding higher public servant grades (including those recognized for passing the examination or considering promotion to a higher grade before Circular 19/2023/TT-BYT takes effect) compared to the grades required for the job positions regulated in Circular 19/2023/TT-BYT are eligible for retention until new salary policy guidelines are issued.
Circular 19/2023/TT-BYT comes into effect on December 22, 2023.
