Circular 12/2023/TT-BNV abolishes 10 Circulars on recruitment and promotion of officials from October 1, 2023, is it correct?
On August 8, 2023, the Ministry of Home Affairs issued Circular 12/2023/TT-BNV abolishing a number of Circulars issued by the Minister of Home Affairs regarding the recruitment of officials and public employees, the promotion of officials, and the rank upgrade of public employees.
Circular 12/2023/TT-BNV abolishes the following Circulars in their entirety:
Circular 13/2010/TT-BNV guiding the recruitment and promotion of officials under Decree 24/2010/ND-CP on the recruitment, use, and management of officials, issued by the Ministry of Home Affairs.
Circular 05/2012/TT-BNV amending Circular 13/2010/TT-BNV guiding the recruitment and promotion of officials under Decree 24/2010/ND-CP on the recruitment, use, and management of officials, issued by the Minister of Home Affairs.
Circular 06/2013/TT-BNV abolishing Article 19 of Circular 13/2010/TT-BNV guiding the recruitment and promotion of officials under Decree 24/2010/ND-CP on the recruitment, use, and management of officials, issued by the Minister of Home Affairs.
Circular 03/2015/TT-BNV amending Article 9 of Circular 13/2010/TT-BNV on the recruitment and promotion of officials under Decree 24/2010/ND-CP on the recruitment, use, and management of officials, issued by the Minister of Home Affairs.
Circular 05/2017/TT-BNV amending Circular 11/2014/TT-BNV and Circular 13/2010/TT-BNV on the professional standards, appointment, and salary arrangement for officials in administrative specialties and the organization of promotion exams for officials, issued by the Minister of Home Affairs.
Circular 12/2012/TT-BNV on job titles and job title changes for public employees, issued by the Minister of Home Affairs.
Circular 15/2012/TT-BNV guiding the recruitment, signing of work contracts, and reimbursement of training and retraining costs for public employees, issued by the Minister of Home Affairs.
Circular 04/2015/TT-BNV amending Circular 15/2012/TT-BNV guiding the recruitment, signing of work contracts, and reimbursement of training and retraining costs for public employees, issued by the Minister of Home Affairs.
Circular 15/2001/TT-BTCCBCP guiding the implementation of policies under Decree 68/2000/ND-CP regarding certain types of contracted work in state administrative agencies and public service providers, issued by the Government's Organization Board of Vietnam.
Circular 03/2019/TT-BNV amending regulations on the recruitment of officials and public employees, the promotion of officials, the rank upgrade of job titles for public employees, and the implementation of policies under certain types of contracted work in state administrative agencies and public service providers, issued by the Minister of Home Affairs.
Circular 12/2023/TT-BNV will take effect from October 1, 2023. In other words, the aforementioned Circulars will officially be abolished from October 1, 2023.

What are the conditions for registering for the 2023 official recruitment according to regulations?
According to Article 36 of Law on Cadres and Civil Servants 2008 (amended by point dd, clause 20 of Article 1 of Law on Amendments and Supplements to the Law on Cadres and Civil Servants and Law on Public Employees 2019), the following conditions apply:
Individuals meeting the following conditions, regardless of ethnicity, gender, social status, belief, or religion, are eligible to register for the official recruitment:
- Having one nationality, which is Vietnamese nationality;- Being 18 years old or older;- Having an application for recruitment; having a clear personal history;- Holding appropriate degrees and certificates;- Having good political and ethical qualities;- Being physically fit to perform duties;- Meeting other conditions as required by the recruitment position.
Note: The following individuals are not eligible to register for the official recruitment:
- Those not residing in Vietnam;- Those who have lost or have limited civil act capacity;- Those who are being prosecuted for criminal liability; those who are serving or have served criminal sentences or decisions of the court without being cleared of criminal records; those subjected to administrative measures such as compulsory rehabilitation or compulsory education.
What are the conditions for registering for the 2023 public employee recruitment according to regulations?
According to Article 22 of the Law on Public Employees 2010 (amended by point a, clause 12 of Article 2 of Law on Amendments and Supplements to the Law on Cadres and Civil Servants and Law on Public Employees 2019), the conditions for registering for public employee recruitment are as follows:
Individuals meeting the following conditions, regardless of ethnicity, gender, social status, belief, or religion, are eligible to register for public employee recruitment:
- Having Vietnamese nationality and residing in Vietnam;- Being 18 years old or older. For certain fields related to culture, arts, physical education, and sports, the recruitment age may be lower as stipulated by law, provided there is written consent from the legal representative;- Having an application for recruitment;- Having a clear personal history;- Holding appropriate training certificates, professional practice certificates, or having suitable skills for the job position;- Being physically fit to perform duties;- Meeting other conditions as required by the job position, as determined by the public service provider but not contrary to legal regulations.
Note: The following individuals are not eligible to register for public employee recruitment:
- Those who have lost civil act capacity or have limited civil act capacity;- Those who are being prosecuted for criminal liability; those serving criminal sentences or court decisions; those subjected to administrative measures such as compulsory rehabilitation, compulsory education, or being sent to a correctional school.
