On July 31, 2024, the Ministry of Natural Resources and Environment issued Circular 11/2024/TT-BTNMT, stipulating the land surveying and assessment techniques; land conservation and restoration techniques.

Circular 11/2024/TT-BTNMT regulates land surveying and assessment techniques; land conservation and restoration techniques, including:

(1) Land surveying and assessment techniques include:

(i) Techniques for surveying and assessing land quality and land potential as stipulated in Clause 1, Article 53 of the Land Law 2024;

(ii) Techniques for surveying and assessing land degradation as stipulated in Clause 2, Article 53 of the Land Law 2024;

(iii) Techniques for surveying and assessing land pollution as stipulated in Clause 3, Article 53 of the Land Law 2024;

(iv) Techniques for monitoring land quality, land degradation, and land pollution as stipulated in Clause 4, Article 53 of the Land Law 2024;

(v) Techniques for thematic land surveying and assessment as stipulated in Clause 2, Article 52 of the Land Law 2024.

(2) Techniques for land protection, improvement, and restoration as stipulated in Article 54 of the Land Law 2024.

Circular 11/2024/TT-BTNMT applies to state management agencies on land, local land management agencies, organizations, individuals conducting land surveying and assessment; land protection, improvement, and restoration; and other related organizations and individuals.

What are the regulations on field investigation map for land surveying and assessment in Vietnam?

Pursuant to Article 5 of Circular 11/2024/TT-BTNMT stipulating the field investigation map for land surveying and assessment in Vietnam as follows:

(1) Regulations on the field investigation map:

- The field investigation map for the investigation and evaluation of land quality, land degradation, and land pollution of the country and regional levels is made on the current land use status map of the provincial level at the same time;

- The field investigation map for the investigation and evaluation of land quality and land degradation at the provincial level is made on the current land use status map of the district level at the same time;

- The field investigation map for the investigation and evaluation of land pollution at the provincial level is made for each contaminated area depending on the influence scope of the pollution source on the current land use status map of the commune level at the same time with scales from 1:2,000 to 1:5,000 or the district level at the same time with scales from 1:10,000 to 1:25,000 for contaminated land surveying and assessment areas located in two or more communes.

(2) Regulations on the content of the field investigation map

- Inherited elements from the current land use status map include: the group of mathematical base layers and related contents; the group of border and administrative boundary layers; the group of topographic layers; the group of transportation, hydrological, and related objects layers; the group of economic and social layers; the group of current land use status layers;

- The boundary of the land plot investigated for land quality and land potential; land degradation; land pollution. The symbol for the boundary of the investigated land plot is shown as stipulated in Section 2, Part B of Appendix I issued together with Circular 11/2024/TT-BTNMT.

The smallest land plot area is determined based on the field investigation boundary and map scale. To be specific:

- Label of the investigated land plot:

The label of the investigated land plot for land quality and land degradation shows investigation information in the following order: abbreviation of the place name, order number of the land plot (shown in Arabic numerals, from 01 to the end within the investigation scope, the order is numbered from left to right, from top to bottom); soil type symbol; topographic symbol.

The label of the investigated land plot for regional land pollution shows investigation information in the following order: abbreviation of the place name; order number of the land plot (shown in Arabic numerals, from 01 to the end within the investigation scope, the order is numbered from left to right, from top to bottom); soil type symbol; the name of the administrative unit at the commune level.

The label of the investigated land plot for provincial land pollution shows investigation information in the following order: abbreviation of the place name; order number of the land plot (shown in Arabic numerals, from 01 to the end within the investigation scope, the order is numbered from left to right, from top to bottom); soil type symbol; symbol of the pollution source;

- The positions of investigation points on the field investigation map are shown in dots;

- Map name, map scale, construction unit, and legend (including: symbols of inherited elements from the current land use status map, investigation land plot boundaries, investigation land plot labels, and investigation point symbols).

What are regulations on subjects of land surveying and assessment; land conservation and restoration in Vietnam?

Based on Article 4 of Circular 11/2024/TT-BTNMT, the subjects of land surveying and assessment; land conservation and restoration in Vietnam are regulated as follows:

(1) Subjects for surveying and assessing land quality and land degradation across the country, socio-economic regions (hereinafter referred to as regional level), and provinces, centrally-controlled cities (hereinafter referred to as provincial level) include agricultural land and unused land (excluding rocky mountainous land without forest trees).

(2) Subjects for surveying and assessing land potential across the country, regional level, and provincial level include agricultural land, non-agricultural land, and unused land.

(3) Subjects for surveying and assessing land pollution:

(i) Subjects for surveying and assessing land pollution across the country and regional level include agricultural land and unused land (excluding rocky mountainous land without forest trees);

(ii) Subjects for surveying and assessing land pollution at the provincial level are lands with pollution sources, including agricultural land; unused land (excluding rocky mountainous land without forest trees); land planned for urban and rural residential areas.

(4) Subjects for monitoring land quality, land degradation, and land pollution are types of land specified in (1) (3) determined according to the fixed monitoring network across the country.

(5) Subjects for thematic land surveying and assessment are one or many types of land stipulated in Article 9 of the Land Law 2024 as decided by the competent state authority to organize the implementation of thematic land surveying and assessment tasks upon approval.

(6) Subjects for land protection, improvement, and restoration are types of land in degraded, polluted areas.
