Is the 30-month service duration for People's Public Security duty against legal regulations?

The duration of active service for conscript soldiers in the People's Public Security is based on Clause 1 Article 8 Law on People's Public Security 2018.

Duty to participate in People's Public Security

1. Citizens performing their duty to participate in the People's Public Security are fulfilling their duty to defend the Fatherland in the people's armed forces. Annually, the People's Public Security selects citizens within the conscription age to serve in the People's Public Security for a period of 24 months. The Minister of Public Security may decide to extend the active service duration of non-commissioned officers and conscript soldiers by no more than 6 months in the following cases:

a) To ensure the task of combat readiness;

b) While performing tasks of disaster prevention, epidemic control, rescue, and salvage.

2. The procedure for selecting citizens to perform the duty to participate in the People's Public Security is applied similarly to the selection of citizens performing military service.

3. The Government of Vietnam stipulates in detail Clause 2 of this Article.

According to the above regulation, the peacetime active military service duration for conscript soldiers in the People's Public Security is 24 months.

However, there are circumstances where the service duration can be extended by no more than 6 months if:

- To ensure the task of combat readiness;- While performing tasks of disaster prevention, epidemic control, rescue, and salvage.

Thus, in cases listed above, the service duration can be extended by no more than 6 months, making a total duration of 30 months, which is not against legal regulations.

When is the health examination timeline for citizens participating in People's Public Security duty?

Article 40 Law on Military Service 2015 stipulates the health examination for citizens conscripted and participating in People's Public Security duty as follows:

4. The health examination period is from November 1 to December 31 annually. The health examination period for conscript citizens and those to participate in People's Public Security duty for the second time as stipulated in Article 33 of this Law is decided by the Prime Minister of Vietnam.

5. Health classification results must be publicly posted at the headquarters of the People's Committees at the commune level, agencies, and organizations within 20 days.

Thus, according to the above regulation, the health examination for People's Public Security duty in 2024 is as follows:

- The health examination period for citizens participating in People's Public Security duty starts from November 1, 2023, to December 31, 2023.

The health examination period for conscript citizens and those participating in People's Public Security duty for the second time as stipulated in Article 33 Law on Military Service 2015 is decided by the Prime Minister of Vietnam.

- The summons for health examination must be delivered to citizens at least 15 days before the examination.- Health classification results must be publicly posted at the headquarters of the People's Committees at the commune level, agencies, and organizations within 20 days.
