What are the regulations on salary step increase schedule for commune-level officials in Vietnam?

Based on Article 6 of Decree 92/2009/ND-CP regulating the salary step increase for commune-level officials as follows:

- Commune-level officials specified at point a, clause 1, Article 5 of Decree 92/2009/ND-CP have a salary step 1 period of 5 years (full 60 months), after completing tasks, without disciplinary action, they will be graded to salary step 2.

- Commune-level officials specified at point b, clause 1, Article 5 of Decree 92/2009/ND-CP and commune-level officials specified at point a, clause 2, Article 5 of Decree 92/2009/ND-CP shall implement salary step increase policies as prescribed in Article 7 of Decree 204/2004/ND-CP.

- Commune-level officials who do not complete tasks or are disciplined from reprimand, warning shall have their salary step increase period extended by 6 months; if dismissed, the salary step increase period shall be extended by 12 months from the effective date of the disciplinary decision.

What is the maximum number of commune-level officials as per current regulations?

Based on Article 4 of Decree 92/2009/ND-CP (amended by clause 1, Article 2 of Decree 34/2019/ND-CP) as follows:

Number of commune-level officials

1. The number of commune-level officials is allocated according to the classification decision of administrative units of communes, wards, and commune-level towns. Specifically, as follows:

a) Category 1: maximum 23 people;

b) Category 2: maximum 21 people;

c) Category 3: maximum 19 people.

2. The provincial People's Committee shall decide the number of commune-level officials equal to or fewer than those stipulated in clause 1 of this Article, ensuring compliance with the titles regulated in Article 3 of this Decree and suitable to the actual situation of the locality. For communes, commune-level towns with regular commune police chiefs, the number of commune-level officials specified in clause 1 of this Article shall be reduced by 1 person.

3. The number of commune-level officials specified in clause 1 of this Article includes officials who are rotated, transferred, or seconded to the commune level. In particular, for officials rotated to hold the position of Deputy Chairman of the People's Committee, the provisions of Decree No. 08/2016/ND-CP dated January 25, 2016, of the Government of Vietnam on the number of Deputy Chairmen of the People's Committee and the process, procedures for election, resignation, dismissal, removal, transfer, and dismissal of members of the People's Committee shall apply.

Thus, the number of commune-level officials is allocated according to the classification decision of administrative units of communes, wards, and commune-level towns. Specifically, as follows:

- Category 1: maximum 23 people;

- Category 2: maximum 21 people;

- Category 3: maximum 19 people.
