What are the requirements of automobile trackers in Vietnam?

In Clause 3, Article 12, Decree 10/2020/ND-CP, amended by Clause 2, Article 1, Decree 47/2022/ND-CP, regulations on automobile trackers are as follows:

3. Automobile trackers must satisfy the following requirements:
a) Automobile trackers shall retain and transmit information on routes, driving speed and non-stop driving time to the vehicle tracking data system of the Ministry of Transport (Directorate for Roads of Vietnam);
b) Information from automobile trackers shall be used for state management of transport and operation of transport businesses and shared with the Ministry of Public Security (Traffic Police Authority) and Ministry of Finance (General Department of Taxation, General Department of Vietnam Customs) for cooperation in state management of traffic order and safety; public order and security; tax; anti-smuggling.
4. Directorate for Roads of Vietnam shall retain data on traffic violations for 03 years.
5. Transport businesses shall maintain operation of automobile trackers to provide the information prescribed in Point a Clause 3 of this Article.
6. Transport businesses and commercial car drivers shall not employ technical measures, peripherals or other measures to disrupt GPS or GSM signal or falsify data from automobile trackers. Before operating an automobile, the driver must use their driver identity card to log in to the automobile tracker and log out after the drive to record their non-stop driving time and daily driving time.

Thus, the automobile trackers must meet the following requirements:

- Automobile trackers shall retain and transmit information to the vehicle tracking data system of the Ministry of Transport (Directorate for Roads of Vietnam), including:

+ routes,

+ driving speed

+ and non-stop driving time

- Information from automobile trackers shall be used for state management of transport and operation of transport businesses and shared with the Ministry of Public Security (Traffic Police Authority) and Ministry of Finance (General Department of Taxation, General Department of Vietnam Customs) for cooperation in state management of traffic order and safety; public order and security; tax; anti-smuggling.

What are the regulations on exploitation and use of image data from auto cameras in Vietnam?

In Article 10 of Circular 12/2020/TT-BGTVT amended by Clause 1, Article 17 of Circular 05/2023/TT-BGTVT, there are regulations on exploitation and use of image data from auto cameras as follows:

- Data exploitation from auto cameras installed on vehicles is carried out in accordance with the law on information technology and other relevant laws.

- Information and data from auto cameras installed on vehicles are used to serve state management of transportation, manage the activities of drivers and vehicles of transportation business units, and provide give:

+ Police agencies (Traffic Police Department, Traffic Police Department;

+ Road and Railway Traffic Police Department;

+ Road Traffic Police Department, Provincial Police, centrally run cities), transport sector (Ministry of Transport, Vietnam Road Administration, Department of Transport) to serve management work. State management, inspection, handling of violations according to the provisions of law and other work to ensure security, order and traffic safety.

- Information and data in the database from auto cameras on the network environment are guaranteed to be safe according to the provisions of information security law and other relevant laws.

- Agencies and units that are granted accounts to access image data software from auto cameras of the Vietnam Road Department must ensure account security and information security according to regulations and exploit and use data to serve management work according to its functions and tasks.
