3. The Vote Counting Committee determines the results of voting by secret ballot based on the following principles:

a) In the case of voting to elect officials in the state apparatus, those who receive more than half of the valid votes compared to the total number of National Assembly deputies and have more affirmative votes, shall be elected. In the event of a tie where more than one person receives an equal number of affirmative votes and has more than half of the valid votes compared to the total number of National Assembly deputies, the National Assembly shall re-vote for these positions among the candidates who received the same number of valid votes. Among those subject to re-voting, the one with the higher number of affirmative votes shall be elected; if the re-vote still results in a tie, the older person shall be elected;

b) The approval of positions in the state apparatus must be endorsed by more than half of the total number of National Assembly deputies;

c) The resignation from the duties of a National Assembly deputy; the dismissal, approval of the request for dismissal, or removal of officials appointed or approved by the National Assembly must be endorsed by more than half of the total number of National Assembly deputies.

The removal of a National Assembly deputy must be endorsed by at least two-thirds of the total number of National Assembly deputies.

Closed session of the National Assembly

1. When necessary, at the request of the President, the Standing Committee of the National Assembly, the Prime Minister of the Government of Vietnam, or at least one-third of the total number of National Assembly deputies, the National Assembly shall decide to hold a closed session and include it in the agenda of the National Assembly session. The Standing Committee of the National Assembly shall propose the National Assembly to consider and decide on holding a closed session according to the following procedures:

a) The Standing Committee of the National Assembly reports on the proposal to hold a closed session;

b) The National Assembly discusses and votes on the holding of the closed session.

2. The participants invited to attend; the recording and minute-taking of the closed session of the National Assembly shall be decided by the Chairman of the National Assembly based on the proposal of the Secretary General of the National Assembly. The order and procedures for considering and deciding on issues at the closed session shall be conducted according to the regulations for sessions at the National Assembly session.
