On February 13, 2023, the Supreme People's Court of Vietnam issued Official Dispatch 78/TANDTC-TCCB in 2023 on the professional training of Court Clerks in 2023.
According to Official Dispatch 78/TANDTC-TCCB in 2023, it is stated that students will enroll court clerk training classes in 2023 with two professions: clerk and principal clerk. With the time and place as follows:
- Class opening time: Scheduled to start in March 2023.
- Location: Court Academy.
- Application documents:
+ Official dispatch of civil servants to study of the unit;
+ List of sending civil servants to school (according to the attached form);
+ Application for schooling of civil servants;
+ Curriculum vitae of civil servants according to form 2C/2008 (issued by the Ministry of Interior), certified by the agency employing civil servants;
+ A written comment and assessment of civil servants by the head of the agency employing civil servants in 2022 for civil servants who are holding the rank of cadres sent for professional training of secretaries and civil servants sent to professional training of principal secretaries;
+ Certified copy: Law university diploma or higher for school subjects who are officers and specialists; Certificate of professional training of Court Clerks for clerks who go to professional training of Principal Clerks.
What are the standards for professional training of secretaries and the profession of principal secretaries guided by the Supreme People's Court of Vietnam?
Pursuant to Section 1 of Official Dispatch 78/TANDTC-TCCB in 2023, the guidance on standards for professional training of secretaries and principal secretaries is as follows:
- Standards for professional training of secretaries:
+ Civil servants who hold the rank of Clerk but have not been trained as Court Clerks (priority is given to sending civil servants for recruitment in 2022)
+ Civil servants holding the rank of specialist or equivalent (with the same salary as specialists such as information technology engineers; accountants ..), have a bachelor's degree or higher
+ Civil servants holding cadre ranks or equivalent (with the same salary as cadres such as intermediate accountants; intermediate archivists ...), have a bachelor's degree or higher, have a minimum staff rank of 02 years and in 2022 successfully complete their work tasks.
- Standards for professional training of Principal Secretaries:
+ Civil servants who have held the rank of Clerk and equivalent to full 08 years or more, excluding probationary and probationary periods, including a minimum of 01 year of holding the rank of Secretary (the "equivalent" period within the scope of this Dispatch is understood to be from the time the civil servant has a bachelor's degree in law);
+ Have been trained as a Court Clerk;
+ Have at least 01 year (in 2022) recognized by the agency to successfully complete the work tasks.
How are the Senior Clerk quota standards regulated in Vietnam?
Pursuant to Article 5 of Decision 1718/QD-TANDTC in 2017, the criteria for senior secretaries are as follows:
- Function: A judicial title with the highest professional requirements for the profession of Court Secretary, arranged at the Supreme People's Court of Vietnam, the Supreme People's Court and the Central Military Court.
-Task:
+ Directly perform the duties of trial clerk, conduct procedural activities in accordance with the procedural law;
+ Perform administrative, judicial and other duties as assigned by the Chief Justice of the Court;
+ Research and guide the professional expertise of the Court Clerk and propose measures and solutions for effective implementation.
- Standards of professional capacity:
+ Master and deeply understanding the system of legal provisions on the profession of trial clerk, proceedings, administrative and judicial tasks;
+ Have the capacity to propose, advise and preside over the development of professional court secretaries associated with the task requirements of the People's Court to submit to competent authorities for consideration and decision;
+ Ability to analyze, synthesize, systematize and propose methods to perfect or solve practical problems posed within the scope of assigned professional expertise;
+ Proficient and master the skills of drafting, presenting, protecting and organizing the performance of tasks related to assigned professional skills;
+ Actively coordinate with relevant agencies and units in performing public duties in accordance with their assigned competence and responsibilities;
+ Ability to apply scientific and technical advances to improve and improve the quality and efficiency of assigned professional work.
- Standards of training and retraining qualifications:
+ Have a bachelor's degree in law or higher;
+ Have an advanced diploma in political theory;
+ Have a foreign language certificate equivalent to level 3 of the Vietnamese foreign language proficiency framework.
+ Have an informatics certificate with a standard of basic information technology skills.
