How long must an individual newly admitted to the Communist Party undergo a probationary period before being recognized as an official Party member?

Based on Article 5 Charter of the Communist Party of Vietnam 2011, the regulations are as follows:

1. An individual newly admitted to the Communist Party must undergo a twelve-month probationary period, starting from the date the party cell organizes the admission ceremony. During the probationary period, the party cell continues to educate, train, and assign official Party members to help the new member progress.

2. At the end of the probationary period, the party cell evaluates and recognizes each individual as an official Party member through the same voting process as when admitting new members; if the individual does not meet the qualifications, the party cell recommends to the competent authority to remove their name from the list of probationary Party members.

3. The resolution of the party cell regarding the recognition of official Party members must be decided by the competent authority.

4. Once officially recognized, the Party membership tenure of a member is calculated from the date mentioned in the admission decision.

An individual newly admitted to the Communist Party must undergo a twelve-month probationary period, starting from the date the party cell organizes the admission ceremony. At the end of the probationary period, the party cell evaluates and recognizes each individual as an official Party member through the same voting process as when admitting new members to the Communist Party.

What are the things that Communist Party members are prohibited from doing?

Based on Chapter I Regulation 37-QD/TW of 2021 issued by the Central Executive Committee of the Communist Party, there are 19 prohibited activities for Party members, including:

(1) Speaking, writing, acting against or failing to implement the Party’s political platform, Charter, resolutions, directives, conclusions, regulations, rules, and decisions; doing things prohibited by law.

(2) Self-nominating, accepting nominations, and nominating for organizational positions without the authorization of the competent Party organization.

(3) Denying or distorting Marxism-Leninism, Ho Chi Minh Thought; failing to set an example; engaging in individualism, opportunism, profiteering; "term mentality," formal democracy, failing to defend what is right, and not fighting against what is wrong; authoritarianism, arbitrariness, bureaucratism, distancing from the masses.

(4) Providing, leaking, losing, or publishing confidential Communist Party and State information, or storing and propagating information in any form contrary to the Party's policies and the State's laws.

(5) Writing false articles or providing false information; composing, producing, storing, and disseminating unhealthy, indecent literature and artwork.

(6) Making false accusations; collaborating with others to write, sign false accusations; submitting anonymous or pseudonymous reports. Threatening, suppressing, retaliating against whistleblowers, and accusers; failing to protect whistleblowers, critics, and contributors.

(7) Organizing or participating in organizations and associations contrary to the Party's regulations, national laws; demonstrating, and gathering crowds causing disorder and security issues.

(8) Organizing, inciting, participating in factions, regionalism causing internal disunity. Using feedback on the Party to attack, falsely accuse, and insult arbitrarily.

(9) Reporting, compiling documents, declaring personal history, and assets dishonestly. Using fake diplomas and certificates; acquiring foreign nationality, transferring money, and assets abroad illegally.

(10) Issuing documents contrary to Party regulations and national laws. Non-conformable actions in management causing damage to the Party and State property.

(11) Violating civil service ethics, covering up, and reporting false information; negligence causing disunity, corruption, waste, and other violations.

- Failing to report and handle acts of corruption, waste, and negativities.

- Interfering or allowing family or others to exploit their position for personal gain.

- Exploiting policies to encourage and protect dynamic, innovative officials for personal gain and corruption.

(12) Engaging in position-buying, cover-up, facilitation, interference, impacting appointments, and policies in contravention of regulations.

(13) Interfering in inspection, surveillance, auditing, prosecution, and judicial activities to cover up violations.

(14) Embezzling, bribing, or mediating bribery under any form; participating in money laundering and unlawful lending practices.

(15) Giving and receiving gifts under any form to influence decision-making, benefiting oneself.

(16) Failing to practice frugality, causing financial waste in managing public funds and property.

(17) Interfering for family, oneself, and others to travel, study, and get medical treatment funded publicly under their management.

(18) Organizing and participating in gambling; using drugs; inappropriate alcohol use, leading to debauchery and other social evils.

Organizing lavish, wasteful personal, family events, or events for profiteering.

Indifference to societal wrongdoings; showing violence in the family; violating population policies; cohabiting outside marriage; violating regulations on marrying foreigners.

(19) Engaging in superstitious practices; supporting or participating in illegal religions or manipulating religious activities for profit.

The prohibitions for Communist Party members are as listed above.

Are Communist Party members required to transfer their Party activities to a new workplace when changing workplaces for less than 1 year?

According to subitem 6.3.2 of Section 6 Regulation 24-QD/TW of 2021, on implementing the Party Charter:

Transfer of Party activities.

...

6.3.2. Temporary transfer of Party activities.

a) When Party members change their residence, workplace for a period from 3 months to less than 1 year; when assigned to study at domestic training institutions for 3 months to 2 years and then return to the original unit, they must undergo the procedure for a temporary transfer of Party activities from the formal Party cell to the new residence, workplace, or study unit. Special cases are regulated by the Central Secretariat.

Thus, according to the above regulation, Communist Party members changing their residence or workplace for a period from 3 months to less than 1 year, or assigned to study at domestic training institutions for 3 months to 2 years and then return to their original unit, must undergo the procedure for a temporary transfer of Party activities from the formal Party cell to the new residence, workplace, or study unit.

Therefore, Communist Party members are not required to transfer their Party activities to a new workplace, except in special cases regulated by the Central Secretariat.
