Pursuant to Article 1 of Decree 86/2022/ND-CP, the Ministry of Education and Training of Vietnam has the following positions and functions:
The Ministry of Education and Training of Vietnam is an agency of the Government, performing the state management function of preschool education, general education, pedagogical intermediate education, pedagogical colleges, higher education, continuing education about: objectives, programs, contents, methods of education; regulations on examination, enrollment, training and diplomas and certificates;
At the same time, develop the contingent of teachers and educational administrators; textbooks, textbooks, documents; school facilities and equipment; quality assurance, education quality accreditation; State management of Vietnamese and ethnic languages; State management of public services within the scope of state management of the ministry.

Does the Ministry of Education and Training of Vietnam no longer have the Emulation and Commendation Department in the organizational structure according to Decree 86/2022/ND-CP?
Pursuant to Article 3 of Decree 86/2022/ND-CP, the Government stipulates the organizational structure of the Ministry of Education and Training of Vietnam, including 20 organizations and 3 public service providers:
- Consists of 16 departmental administrative units: Preschool Education; Primary education; Secondary Education; University education; Physical education; Ethnic education; Continuing Education; Defense and Security Education; Political Education and Student Work; Personnel organization; Planning - Finance; Infrastructure; Science, Technology and Environment; Legislation; Office and Inspector.
- 4 Departments: Quality Management; Teachers and Education Managers; Information technology; International cooperation.
- 3 public service providers, serving the state management function of the Ministry, including: Vietnam Institute of Educational Sciences; Education and Times Newspaper; Education Magazine.
Compared to the organizational structure of the previous Ministry of Education and Training of Vietnam in Article 3 of Decree 69/2017/ND-CP. The Ministry of Education and Training of Vietnam is now reducing 3 units: the Department of Emulation - Commendation, the Academy of Education Management and the Ho Chi Minh City School of Education Managers.
Thus, the current organizational structure of the Ministry of Education and Training of Vietnam no longer has the Emulation and Commendation Department as before.
Supplementing new functions and tasks of the Ministry of Education and Training of Vietnam for state management of Vietnamese and ethnic languages?
Pursuant to Clause 4, Article 2 of Decree 86/2022/ND-CP, the state management of Vietnamese and ethnic languages has been added by the government to the functions and tasks of the Ministry of Education and Training of Vietnam. Specifically, the tasks of state management of Vietnamese and ethnic languages include the following:
To assume the prime responsibility for, and coordinate with concerned ministries and branches in, formulating and submitting to the Government for promulgation regulations on policies on development and conservation of Vietnamese and ethnic languages;
In addition, in Article 2 of Decree 86/2022/ND-CP, the Ministry of Education and Training of Vietnam has the following outstanding duties and powers:
- About the law
+ Submit to the Government a law project, a draft resolution of the National Assembly, an ordinance project, a draft resolution of the National Assembly Standing Committee, a draft decree of the Government according to annual law-making programs and plans and resolutions, projects and schemes as assigned by the Government or the Prime Minister;
+ Submitting to the Government for comments on draft laws and ordinances submitted by agencies, organizations and National Assembly deputies to the National Assembly and Standing Committee of the National Assembly related to the sectors and fields under the state management of the ministry;
+ To submit to the Government for decision measures to organize the implementation of the Constitution, laws and resolutions of the National Assembly, ordinances and resolutions of the National Assembly Standing Committee, orders and decisions of the State President as assigned by the National Assembly. Government, Prime Minister;
+ Submit to the Prime Minister draft decisions, directives and other documents as assigned;
+ To promulgate circulars and other documents on state management of branches and domains under the ministry's state management; guide and inspect the implementation of such documents;
+ Promulgate a joint circular with the Chief Justice of the Supreme People's Court and the Chief Procurator of the Supreme People's Procuracy to regulate the coordination between the Ministry of Education and Training of Vietnam, the Supreme People's Court, Supreme People's Procuracy in the implementation of procedural order and procedures related to the scope of state management of the ministry;
+ Direct and organize the implementation of the propaganda, dissemination and education of the law under the scope of state management of the Ministry;
+ Examine legal documents promulgated by ministries, People's Councils and People's Committees of provinces and centrally run cities related to branches and domains under the ministry's state management;
+ If it is detected that the regulations promulgated by such agencies show signs of being contrary to legal documents in the branches and domains under the management of the Ministry, they shall propose handling in accordance with the provisions of law.
- About textbooks, textbooks, documents
+ Prescribing standards and selection of toys and learning materials used in preschool educational institutions;
+ To prescribe standards and procedures for compiling and editing general education textbooks; stipulating the selection of textbooks in general education institutions;
+ Regulations on textbooks, curriculum, continuing education materials;
+ Regulations on the compilation, selection, evaluation, approval and use of teaching materials and textbooks of higher education and colleges of pedagogy.
- About exams, tests, enrollment, training and diplomas and certificates
+ Submitting to the Government for promulgation a system of higher education diplomas and regulations on equivalent qualifications of a number of specialized training disciplines within the scope of state management of the ministry;
+ To prescribe the examination, examination, enrollment, training, joint training and management of diplomas and certificates in the national education system under the state management scope of the ministry;
+ Regulations on the recognition of diplomas granted by foreign educational institutions to be used in Vietnam, etc.
