The list of hazardous chemicals must develop a plan for prevention and response to chemical incident in Vietnam in 2022?
Pursuant to Article 38 of the Law on Chemicals 2007 stipulates as follows:
“Article 38. List of hazardous chemicals for which a chemical incident prevention and response plan must be developed
1. Based on the hazardous properties of chemicals, the scale of production, trading and use of chemicals, the Government shall promulgate a list of hazardous chemicals subject to formulation of a chemical incident prevention and response plan. .
2. The Ministry of Industry and Trade shall assume the prime responsibility for, and coordinate with concerned ministries and branches in, formulating the list specified in Clause 1 of this Article and submitting it to the Government for promulgation.”
Currently, the list of marine hazardous chemicals for development of a chemical incident in Vietnam prevention and response plan is specified in Appendix IV issued with Decree 113/2017-ND-CP as follows:

What must be included in a chemical incident in Vietnam response plan?
Pursuant to Article 39 of the Law on Chemicals 2007 stipulates as follows:
“Article 39. Contents of the chemical incident prevention and response plan
1. Information on characteristics, volume, technology of chemical production and use, characteristics of geographical conditions, population and environment where chemical activities are conducted.
2. Forecast of risks causing incidents and plans for inspection and monitoring of risk sources of chemical incidents.
3. Forecast of chemical incidents and preventive measures.
4. Chemical incident response capacity includes equipment, human resources, plan to coordinate with local forces, plan to evacuate people and property.
5. Plans for overcoming consequences of chemical incidents according to the provisions of the law on environmental protection and other relevant laws.
Accordingly, the plan for prevention and response to chemical incident in Vietnam must contain all the contents as prescribed above.
Responsibilities for coordination in prevention and response to chemical incident in Vietnam are regulated?
Pursuant to Article 42 of the Law on Chemicals 2007 stipulates as follows:
“Article 42. Responsibility for coordination in prevention and response to chemical incidents
1. Organizations and individuals engaged in chemical activities on the list specified in Clause 1, Article 38 of this Law must provide the People's Committees at all levels and local fire prevention and fighting agencies with the contents specified in the regulations. Clauses 3, 4 and 5, Article 39 of this Law to coordinate in responding to chemical incidents; in case the chemical operation establishment is located in an industrial park, export processing zone or economic zone, it must also provide the aforesaid contents to the management board of the industrial park, export processing zone or economic zone.
2. When chemical incidents occur, organizations and individuals engaged in chemical activities must promptly apply chemical incident prevention and response measures, chemical incident prevention and response plans, and promptly notify the fire prevention and fighting forces, relevant agencies and units, and the nearest local authorities to coordinate in responding to and overcoming incidents.
3. When a serious chemical incident occurs, the responsibility for coordinating response is prescribed as follows:
a) Chemical facilities must promptly take the response measures specified in Clause 2 of this Article;
b) The People's Committee of the commune, ward or township where the chemical incident occurs shall promptly mobilize on-site forces and apply other necessary measures, and at the same time report it to the district People's Committee. districts, towns and provincial cities to mobilize forces to carry out rescue measures, evacuate people and property and immediately report to the President of the provincial People's Committee;
c) Presidents of the People's Committees of provinces shall directly direct the response to and remedy the consequences of chemical incidents;
d) The line ministries and the Ministry of Industry and Trade are responsible for promptly coordinating with the provincial-level People's Committees of the localities where the incidents occur to respond to and remedy the consequences of the chemical incidents;
dd) Organizations and individuals are responsible for complying with the mobilization of people and property by competent state agencies to respond to and overcome consequences of chemical incidents in accordance with law;
e) The President of the People's Committee of the province where the incident occurs must immediately notify the National Rescue Committee and relevant agencies for coordination in handling according to the provisions of law.
Accordingly, organizations and individuals will have the responsibility to coordinate with each other to prevent and respond to chemical incident in Vietnam in accordance with the above provisions.
