What is a death certificate used for?
In case someone dies, the relatives of this deceased person will be obliged to go to the People's Committee of the place of residence to notify the death registration. After notifying and completing the procedures for death registration, the People's Committee will return the results of the registration procedure with a death certificate.
A death certificate is used to confirm that a person has died and has completely terminated his legal relations from the time of death certificate. The death certificate is one of the legal bases to determine a number of specific issues as follows:
- Determining the time to open the inheritance, the inheritance line;
- Settlement of death regime;
- Determination of common property of husband and wife;
- Confirm your marital status when you want to register your marriage with someone else...
However, Clause 2 Article 34 of the Law on Civil Status 2014 of Vietnam stipulates that immediately after receiving papers specified in Clause 1 of this Article, if seeing that the death declaration is proper, the justice and civil status officer shall record the death declaration contents in the civil status book and together with the death declarant sign in the civil status book and report to the chairperson of the commune-level People's Committee to issue an extract to the death declarant. The justice and civil status officer shall close civil status information of the deceased person in the electronic civil status database.
According to the above regulations, now, after carrying out the procedures for death registration, the competent authority will issue a death declaration extract to the person declaring the death instead of issuing a death certificate as before.
The death certificate extract obtains information about a person's death registration in the civil status book and the death certificate extract is the same as a "copy" of the death certificate and has the same legal value as the death certificate.

Instructions for documents and procedures for making death certificates in 2022?
Pursuant to the provisions of Article 33 of the Law on Civil Status 2014 of Vietnam, within 15 days after the date a person dies, his/her spouse, child, parent or another relative shall register his/her death; for a deceased person without any relative, a representative of a related agency, organization or person shall register his/her death.
Documents to be prepared for death registration are as follows:
- Declaration of death registration;
- Death notice or replacement papers such as:
+ In case the person dies at a medical facility, the head of the medical facility shall issue the death notice;
+ In case the person dies due to execution of the death sentence, the Chairman of the death sentence execution council will be the person to issue a certificate certifying the execution of the death sentence instead of the death notice.
- Authorization letter in case of authorization to carry out death registration.
In case the authorized person is a grandfather, grandmother, father, mother, child, wife, husband, brother, sister or younger brother of the principal, the power of attorney is not required to be notarized or authenticated, but must have documents proving the relationship with the attorney.
Documents to be presented include:
+ Passport/ID card/Citizen ID card or other papers with photos and personal information attached;
+ Papers proving the last place of residence of the deceased to determine the jurisdiction (in case the National Population Database and the National Electronic Civil Status Database are incomplete);
If the last place of residence of the deceased cannot be determined, a document proving the place of death or the place where the dead person's body was discovered shall be presented.
Note: When the application is sent by post, the sender needs to enclose certified copies of the above-mentioned documents.
The procedures for making a death certificate include the following steps:
Step 01: Submit application
Resumes will be sent to:
- Commune-level People's Committees of the last residence of Vietnamese citizens
- The district-level People's Committee of the last place of residence of a foreigner or Vietnamese citizen residing abroad who died in Vietnam.
- Communal People's Committees in border areas for foreigners residing in that commune.
Step 02: Check profile
- If the application is complete and valid, write a receipt, clearly stating the date and time of returning the results.
- If the application is incomplete or incomplete, the examiner will guide the applicant to supplement and complete the application according to regulations.
If the dossier is not fully supplemented and completed after being guided as prescribed, the recipient shall refuse to receive the dossier and make a written refusal to receive the dossier.
When it is not possible to supplement or complete the dossier immediately, a written instruction must be made, clearly stating the types of papers and contents to be supplemented, completed, signed, and clearly written the full name, middle name and name of the recipient.
