Pursuant to the provisions in Part II of Administrative procedures for amendments, supplements and abolition in the fields of Fine Arts, Photography and Exhibitions under the scope of management functions of the Ministry of Culture, Sports and Tourism issued with Decision 3698/QD-BVHTTDL in 2023, the procedure for approving the content of imported fine art works and photographic works under the authority of the Department of Culture, Sports and Tourism is as follows:

(*) The order of execution:

+ Local organizations and individuals requesting approval of the content of fine art works and photographic works must send 01 set of documents directly by mail to the Department of Culture, Sports and Tourism/Department of Culture and Sports.

+ Within 05 working days from the date of receipt of the dossier, if the dossier is not complete and valid, the competent authority shall notify the trader in writing to request additional complete and valid dossiers. rule.

+ Within 07 working days from the date of receipt of complete and valid documents, the competent authority will respond in writing with the results of approval of the content of imported works. In case of disapproval of the work's content, the competent authority must respond in writing and clearly state the reason.

The document approving the content of the work is the basis for traders to carry out import procedures at customs.

(*) Performing methods:

Submit in person or by mail to the Department of Fine Arts, Photography and Exhibitions or submit your application online via the Public Service Portal of the Department of Culture, Sports and Tourism/Department of Culture and Sports.

(*) Components and number of documents:

+ Profile components:

(1) Application for approval of the content of fine art works and photographic works (Appendix VI issued with Circular 13/2023/TT-BVHTTDL dated October 30, 2023 amending and supplementing regulations related to documents Citizen sheet in a number of Circulars issued by the Minister of Culture, Sports and Tourism)

(2) Images of imported works, clearly stating the material and size.

+ Number of documents: 01 set.

(*) Processing time:

Within 05 working days from the date of receipt of the dossier, if the dossier is not complete and valid, the competent authority shall notify the trader in writing to request additional valid dossier.

Within 07 working days from the date of receipt of complete and valid documents, the competent authority will respond in writing with the results of approval of the content of imported works. (*) Fees and charges:

(1) For works of art

+ For the first 10 works: 300,000 VND/work/appraisal.

+ For the 11th to 49th work: 270,000 VND/work/appraisal.

+ For the 50th work onwards: 240,000 VND/work/appraisal, maximum not exceeding 15,000,000 VND

(2) For photographic works:

+ For the first 10 works: 100,000 VND/work/appraisal.

+ For the 11th to 49th work: 90,000 VND/work/appraisal.

+ For the 50th work onwards: 80,000 VND/work/appraisal.

Pursuant to the provisions of Article 7 of Circular 28/2014/TT-BVHTTDL amended by Clause 14, Article 1 of Circular 26/2018/TT-BVHTTDL, there are provisions:

Authority to approve content of imported fine art works and photographic works:
a) The Department of Fine Arts, Photography and Exhibition receives documents and approves the content of fine art works and photographic works imported by organizations under the Central agency;
b) The Department of Culture, Sports and Tourism receives documents and approves the content of fine art works and photographic works imported by the remaining local subjects.

Thus, the authority to approve the content of imported fine art works and photographic works belongs to two entities as follows:

(1) The Department of Fine Arts, Photography and Exhibitions under the Ministry of Culture, Sports and Tourism approves works imported by organizations under central agencies.

(2) The Department of Culture, Sports and Tourism approves works imported by the remaining local entities.

Which fine art works and photographic works are banned from being imported into Vietnam?

Pursuant to the provisions of Article 6 of Circular 28/2014/TT-BVHTTDL, the following fine art works and photographic works are banned from import into Vietnam:

- Inciting people to come out against the Socialist Republic of Vietnam and sabotaging the united bloc of the whole people;

- Propaganda to incite violence, war of expansion; cause hatred among the peoples; spread reactionary ideas, culture, obscene and dissolute lifestyles, criminal acts, debaucheries, superstitions against practices and customs, harming ecological environmental health;

- Information that discloses secrecy of the Communist Party and State, secrecy of military, security, economy, foreign policy, privacy of individuals and other secrets as defined by the law;

- Distorting historical truth; denying revolution achievements; hurting the people, great people and national heroes, heroines; slandering and hurting reputation of agencies, organizations and dignity of individuals;

- Information that is not appropriate for ethical, cultural and traditional values of the people;

Any cultural product that is defined as being banned or suspended from circulation, subject to revocation, confiscation, destruction or violating the law on copyrights;

Decision 3698/QD-BVHTTDL in 2023 will take effect from January 15, 2024.
